Kerala HC quashes case against Sudhakaran, another accused
Police filed a chargesheet against the accused in the trial court and mentioned that the probe against their associates, including Sudhakaran and Rajeevan, was progressing.
Sasi died during the trial and the court convicted Dineshan. Andhra Pradesh HC later acquitted him, and the apex court confirmed it.
It was alleged that Sudhakaran conspired with the other accused at Govt Guest House in Thycaud, Thiruvananthapuram, to eliminate certain CPM leaders due to political enmity in March 1995. It was also alleged that the accused decided to kill Jayarajan on Rajadhani Express train after knowing that he was travelling on it in April 1995.
The petitioners argued that since the conspiracy an gle was already investigated by police and tried by the court in Andhra Pradesh, the case registered by Kerala police on the same matter would not legally sustain. They also argued that a second FIR in the same case was invalid in law.
Orders should have been sought for further investigation in the case registered by Chirala police, it said.
