Chevron reversal and cybersecurity - from Inés Jordan-Zoob, Tanvi C., and me. https://lnkd.in/esg_WaSE This post focuses on how the Supreme Court's recent reversal of the Chevron doctrine impacts cybersecurity regulation and enforcement. Some takeaways: 1) Existing cybersecurity regulations and agency enforcement actions are more vulnerable to court challenges. Potential lawsuits on several regulations may already be in the works, including the expansion of prescriptive cyber incident reporting rules. 2) Future rulemakings and enforcement actions will need to reflect statutory authority to survive litigation intact. This makes a “creative approach” to critical infrastructure cybersecurity regulation riskier. 3) A wave of litigation may cause inconsistent application of cybersecurity regulations across jurisdictions. Cybersecurity compliance programs may need to evolve to a regulatory environment that changes more frequently.
