On 2 August 2024, the Federal Court of Australia handed down its decision in ASIC v Mercer Superannuation (Australia) Limited 2024 [FCA] 850. In this landmark decision, the Federal Court has ordered Mercer to pay an $11.3 million penalty after Mercer admitted that it had made misleading statements concerning the sustainable nature and characteristics of some of its superannuation investment options.
