Mit Wirkung ab dem 1. Oktober 2024 bringt eine Änderung des Zweitwohnungsgesetzes wesentliche Neuerungen für den Umbau von altrechtlichen Wohnungen. Neu dürfen beim Umbau altrechtlicher Wohnungen auch zusätzliche Wohnungen und Gebäude im Umfang von höchstens 30% geschaffen werden. Es besteht nun auch die Möglichkeit des Abbruchs und Wiederaufbaus solcher Wohnungen. Bisher war lediglich eine Erweiterung der altrechtlichen Wohnungen um maximal 30% erlaubt, wenn dadurch keine neuen Wohnungen geschaffen wurden. Diese Anpassung hat praktische Auswirkungen auf Gemeinden mit einem Zweitwohnungsanteil von über 20%. Looking to continue its European expansion, Circet has successfully acquired Isen Tiefbau Group. From its established base in Otelfingen, Switzerland, Isen Tiefbau Group specialises in civil engineering with a particular focus on providing and supporting telecommunication infrastructure in the German-speaking part of Switzerland. In two significant rulings dated 6 August 2024, the Swiss Federal Supreme Court (FSC) clarified crucial aspects of legal privilege in internal investigations. The FSC confirmed that attorney-client privilege applies to internal investigation reports, resolving uncertainties from earlier rulings. Importantly, the Court determined that voluntary disclosure of such findings to a regulator does not waive this privilege. However, the FSC also concluded that attorney-client privilege does not extend to third parties to whom the documents were disclosed. In the cases under review, this allowed the bank concerned to successfully invoke privilege, but the Prosecutor's Office was still able to obtain the sought-after information from FINMA. The Secretariat of the Swiss Competition Commission (Secretariat) has published its closing report on its extensive preliminary investigation analyzing the conduct of more than 200 companies in relation to the exchange of information on salaries and fringe benefits. The Secretariat held that such an exchange could constitute an unlawful price cartel and be subject to fines. However, rather than opening formal investigations to impose such fines, the Secretariat decided to develop best practices in close cooperation with the relevant stakeholders such as employers, unions and agencies. In its recently published judgement 5A_691/2023 of 13 August 2024, the Swiss Federal Supreme Court clarified how compliance with time limits set out in months are to be calculated according to the Civil Procedural Code (CPC). ▪ A time limit set out in months ends on the day bearing the same number as the day on which the time limit began to run. ▪ According to the Swiss Federal Supreme Court, the time limit begins to run on the day of the triggering event (e.g. day of the notification of a decision). ▪ This is different from the time limits set out in days, which according to the CPC, only begin to run on the day after the triggering event. This landmark decision has practical implications in particular for calculating the three-month period of validity of an authorization to sue, most notably in cases where the forfeiture of time limits (𝘝𝘦𝘳𝘸𝘪𝘳𝘬𝘶𝘯𝘨) is at issue. The transaction occurs in parallel to the proposed sale of SG Kleinwort Hambros in the UK, for a combined value of €900 million.
