Milton Parker, 59, lashed out at then 11-year-old Anatoly Veltman – who has the mental capacity of six.
Veltman is said to have thrown ice and a napkin on the floor of the school's lunch room before making a racist remark.

The footage shows the boy hitting out at Parker, before the teacher hits back at the autistic pupil.
Veltman, now 13, is terrified of returning to the school in New York, forcing his parents to home school him for the last two years.

His father, Anatoly Veltman Sr, said: "My son, now even when we pass by the school, he runs away from me.
"He's afraid of the school building since what happened to him."
Parker, who has since retired from teaching, claims the attack was in self defence.
He said: “Who gets hit and doesn’t respond? The kid punched me in the eye first and as a reflex he got hit back.”
He added: “I knew it was on camera. If it was intentional, I would have taken him to another room and beaten the snot out of him.”

Veltman’s family have filed a massive $5.5million (£3.8million) lawsuit against the teacher and the New York’s Department of Education.
The family’s lawyer, Sanford Rubenstein said: "It is outrageous and unacceptable for a school paraprofessional to punch an 11-year-old autistic child."
Mr Parker, who has pleaded guilty to punching the child, said that his life was “destroyed” because of the classroom incident and that he has no assets to give the family.
