CONTENT
The bill would amend the Natural Resources and Environmental Protection Act (NREPA) to extend the sunset dates for certain fees collected by the Department of Environment, Great Lakes, and Energy (EGLE). The bill also would amend NREPA to remove provisions in Section 11135 related to a $8 processing user charge for hazardous waste manifest (this provision expired on October 1, 2021).
The bill would extend the sunset dates to October 1, 2025, for the following fees:
�-- Floodplain permit application fees (Section 3104).
�-- Wastewater and storm water operator training and certification fees (Sections 3110 and 4104).
�-- Stormwater discharge fees (Section 3118).
�-- Surface water discharge fees (Section 3120).
�-- Hazardous waste handler user charges (Section 11153).
�-- Land and water permit fees (Sections 30104, 30109, 32312, and 32513).
FISCAL IMPACT
The bill would have a positive fiscal impact on EGLE. The bill would extend the sunsets for current fees. Therefore, fee revenue for the extended fees would continue to be determined by the volume of permits issued and user fees assessed. According to the Department, these fees equaled a total of $7.9 million in fiscal year 2020-21, as shown in the table below. If the bill were not enacted, then this would represent a projected loss of annual revenue for EGLE in the amount of $7.9 million.
