    DiCello Levitt was commended in the latest edition of Law360’s “Legal Lions of the Week” following a landmark victory for users of Google’s Chrome web browser. Citing an August 20 ruling from a unanimous Ninth Circuit panel, the publication recognized DiCello Levitt and co-counsel Simmons Hanly and Bleichmar Fonti, as well as appellate counsel at Gupta Wessler, for our successful work to reinstate a nationwide data privacy class action that challenges Google’s surreptitious collection of Chrome browser users’ personal data without consent.   The ruling not only represents a major win for our clients and the proposed class but also could have significant implications for ongoing and future privacy litigation.   Read here for Law360’s mention of DiCello Levitt and our co-counsel in “Legal Lions of the Week”: https://bit.ly/3Z7bcjL

    Following the vicious attack of Jaemiir McElroy by Canton police, Jaemiir's attorney, Bobby DiCello, issued this statement: “The family of Jaemiir McElroy are sickened by the senseless and cruel acts of violence that Jaemiir endured on Saturday.    It should not be lost on anyone that after officers attacked him and hospitalized him, they issued charges which find no support in the video. One of those charges, resisting arrest, is not justified by the video: Jaemiir is on his knees with his hands in the air when he is kicked in the head by an officer who charges at him.   The family is resolved to get justice for Jaemiir. It is time for the City of Canton to wake up and realize that its police department is attacking its own citizens and treating them as enemy combatants rather than citizens.   We remain committed to holding these officers accountable.”

    Michael Donnell Jones’s life was tragically cut short on August 17, 2024. The recent release of body camera footage has brought unimaginable pain to his family, who witnessed the harrowing moments leading up to their father's death. Partner Bobby DiCello, representing Michael’s family, stated, “The children of Michael Donnell Jones had a private viewing of the video which showed the last, tragic moments of Michael’s life, and were devastated by what they saw. They struggle to understand why the [police] officers leapt into the truck, why they then tased him, and why they shot him, especially when Michael made no threats toward them of any kind.” Councilman-at-Large Eric D. Garrett Sr. expressed deep concern, noting, " After reviewing the body-worn camera footage, it is heartbreakingly clear that Michael Jones did not have to die. … This incident underscores the urgent need to change how police officers respond to situations.” For additional details, read: https://bit.ly/4cEh8DL

    Yesterday, DiCello Levitt’s Chicago office hosted the Promoting Competition and Fighting Corporate Power Reception, a significant event jointly organized by the Committee to Support Antitrust Laws (COSAL) and Fight Corporate Monopolies during the Democratic National Convention. The reception brought together leading voices in the fight against corporate dominance, including Sens. Amy Klobuchar, Richard Blumenthal, Ed Markey, and Chris Murphy; Reps. Pramila Jayapal and Jerry Nadler; Colorado Attorney General Phil Weiser; and Minnesota Attorney General Keith Ellison. These guests shared insights on promoting fair market competition and tackling the pressing challenges posed by corporate power. DiCello Levitt is proud to support this critical dialogue, with Partner Gregory Asciolla, chair of our Antitrust and Competition Litigation Practice Group and vice president of COSAL, and Partner Alexander Barnett, a former president of COSAL, playing integral roles in advancing this mission.     Meet our Cleveland office summer associates, Dawlat (Dolly) Alexander and Maeve Walsh. They have been fantastic additions to our team this summer, making valuable contributions in many areas.   Dolly is a rising 3L at Cleveland State University College of Law who is passionate about consumer protection and social justice. As the co-founder and president of the Housing Impact Project, Dolly mobilizes students to advocate for safe, affordable housing and decriminalize homelessness. With a background in biochemistry and real estate, as well as experience as a lawyer referral specialist and legal secretary, Dolly has brought a well-rounded perspective to our team. Maeve, a rising 2L at Cleveland State University College of Law, is active in the Student Public Interest Law Organization and the Women’s Law Student Association. Her experience as a former journalist includes roles as a digital reporter, special projects editor for The Lantern, and metro desk intern at The Columbus Dispatch. Additionally, Maeve has worked as a research associate at a political opposition research firm. We look forward to their continued success and are confident they will excel in their endeavors as they return to law school this fall and continue their journey here at DiCello Levitt!

    Partner David Straite and the DiCello Levitt team, alongside co-counsel Simmons Hanly Conroy LLP and Bleichmar Fonti & Auld LLP, secured a landmark victory in the U.S. Court of Appeals for the Ninth Circuit, reinstating claims that Google unlawfully collected sensitive personal information from Chrome users without their consent. The court fully rejected Google's argument, ruling that Google's promises about privacy should be understood based on what a typical user would expect rather than a complicated standard requiring extensive expert testimony.   This decision sends the case back to the district court for trial, pending plaintiff class certification, and requires a jury to determine how a reasonable Chrome user with ordinary computer skills would have understood Google's disclosures and promises.   Read more: https://bit.ly/4dMAQyN

    Amy Keller, chair of DiCello Levitt’s Privacy, Technology, and Cybersecurity Practice Group, was appointed OnStar Track Co-Lead Counsel in the multidistrict litigation case, In re Consumer Vehicle Driving Data Tracking Collection. This case addresses the unauthorized tracking and collection of consumer vehicle driving data by major corporations, including General Motors, OnStar, LexisNexis Risk Solutions Inc., and Verisk Analytics Inc. DiCello Levitt took a leading role by filing one of the initial class action complaints, highlighting the severe breach of privacy and trust affecting countless consumers nationwide.
