The FTC Non-Compete Rule scheduled to become effective September 4th was blocked from taking effect yesterday in the federal court in Texas. Judge Ada Brown of the U.S. District Court for the Northern District of Texas ruled that the FTC lacks the authority to issue substantive rules related to unfair methods of competition, and blocked the scheduled enforcement of the FTC Rule prohibiting non-competes, and requiring notice to all non-executive employees that any non-competes in place are invalid and that are free to compete or start a new business that is competitive with their employer. The injunction issued by Judge Brown against the FTC Rule is permanent, and nationwide in scope. The FTC is considering an appeal and has stated that will continue to oppose non-competes on a case-by-case basis. Read More:https://ow.ly/7w9j50T3nnr
