🔒 A Texas judge blocked the FTC’s near-total ban on non-competes. However, the FTC is considering an appeal. Stefanie Camfield, Director of HR Services and Assistant General Counsel at Engage PEO spoke with Bloomberg and said if it reaches the Supreme Court, “SCOTUS will likely throw it out entirely.” Here is her guidance on what employers can do: - Prepare to inform employees, but hold off for further clarity from appeals. - Consider other legal ways to protect trade secrets and other sensitive information. 👥 Impact: 30 million American workers could be affected. We notified our clients yesterday that the Federal Trade Commission's proposed ban on non-compete agreements has been effectively blocked by a federal judge in Texas. For now, existing non-compete agreements remain #enforceable, and employers may enter into new non-competes. The FTC will likely appeal the judge's decision. In the meantime, employers should still review existing non-compete agreements and consider using other restrictive covenants to protect confidential or proprietary business information. #InsuranceAgents #PEO #HRCompliance #SMB

🚨 Roughly 20% of workers have signed non-compete agreements. 🚨 A Texas judge has #blocked the FTC's nationwide ban on non-compete agreements that was set to go into effect on Sept. 4, citing the agency's lack of authority and evidence.
