F45, the fitness training company partially owned by Mark Wahlberg, is in hot water with one of its top brand ambassadors... Back in 2020, David Beckham signed on to be one of F45's global brand ambassadors. In exchange for posting content on his Instagram, F45 agreed to pay Beckham in shares of F45 within six months of the company's IPO in July 2021. However, after the IPO, F45 delayed payment to Beckham until February 2022, when the company's stock price plunged. As a result, the shares promised to Beckham lost about $9.3 million in value, so Beckham is suing F45 for breach of contract. Although it is uncertain whether this case will go to trial or settle out of court, it is very clear that F45 could have saved itself millions if it had just abided by its agreement with Beckham. This case is a great reminder that, when brands engage with celebrities in an agreement, they must make sure they live up to their end of the bargain too! Endorsements and licensing deals are both great ways to leverage a celebrity's fame to sell goods or services... but what's the difference between the two? While an endorsement is usually a short-term deal in which a celebrity agrees to promote another brand's product, licensing deals are typically longer term agreements where the celebrity "leases" their intellectual property to another entity to make the celeb's branded products. For example, Shaquille O'Neal's collaboration with Epson is an endorsement, while his collaboration with Reebok is a licensing deal. Want to learn more about these important agreements? The WNBA's newest star, Caitlin Clark, is set to make millions this year, despite her salary, thanks to outside brand deals! Caitlin is poised to sign a $28 million deal with Nike to become the fourth WNBA player to develop her own signature shoe line. She also currently has deals with Gatorade, Buick, Bose, and State Farm. Fashion brands already have their eyes on Caitlin, with Prada dressing her for this year's WNBA draft. She is the first player in the NBA or WNBA to be dressed by the Italian fashion house on draft night. Brands looking to stay on the precipice of pop culture will be watching Caitlin closely to align on brand endorsements and deals. This proposal could cause big changes at the USPTO!   Currently, the USPTO does not register trademarks for Schedule I controlled substances like marijuana.   But this policy could change if the DEA gets its way and marijuana is reclassified to Schedule III.   Trademarks for marijuana goods and services could be allowed federal registration, alongside other controlled substances like OxyContin, Adderall, and Subutex.   This would help businesses protect against infringers, and it would help address the marijuana counterfeiting problem plaguing the nation.   The proposal still has to go through the formal rulemaking process, so for now, marijuana trademarks are still unregistrable.   Follow along for updates on this exciting change in the law!   Disclaimer: Your legal matter, case and/or outcome may vary.
