OOPS! The California Senate passed AB 3048 yesterday, requiring browsers and mobile operating systems to support Opt-Out Preference Signals. Once the Assembly passes this amended version as expected, the Governor will have until Sept. 30 to sign. Initial takeaways on the Frankfurt Kurnit Klein & Selz Technology Law Blog: 💥An OOPS is defined to not only communicate a consumer's request to opt out of the sale or share, but alternatively also their request to limit the use of a consumer's sensitive personal information. This expansion was not previously included in the regulations but was contemplated in the statute. 📱 Mobile OS: the CPPA is tasked with another regs package, this time updating its requirements and technical specifications for an OOPS in sec. 7025, etc. for the mobile context. There will always be rulemaking. 💰 Choice screens, pop-ups, settings? How the OOPS is designed may impact ad monetization on the scale of Apple's ATT framework or Google's Advertising ID program. It remains to be seen how OOPS will interact with these existing frameworks.
