The recently enacted amendment (SB2979) to Illinois’ Biometric Information Privacy Act (BIPA) significantly reduces the damages available under the statute. This amendment may also reduce the overall volume of BIPA class action litigation in Illinois. Stephanie Weiner and Sarah Jansen secured a dismissal with prejudice in the Northern District of Illinois on behalf of a municipality. The claim involved allegations of false arrest following a 2018 arrest. However, plaintiff did not file his lawsuit until August 2023. The Court found that the two-year statute of limitations period started upon plaintiff’s arrest, and that contrary to plaintiff’s argument, there was no basis to pause, delay, or extend the running of that time period. Therefore, the Court ruled that plaintiff’s suit was terminated and could not be refiled. https://lnkd.in/g_JY5eZ7

Just prior to the conclusion of a Cook County jury trial, Mary Nielsen and Chelsea L. Caldwell received a directed verdict on behalf of a Cook County area hospital. Plaintiff had claimed that an independently contracted ophthalmologist working in the hospital’s emergency department failed to recommend the appropriate medication be administered to treat his central retinal artery occlusion. Nielsen and Caldwell successfully argued that the Plaintiff had failed to prove the defendant ophthalmologist was the apparent agent of the hospital. https://lnkd.in/gaszP-tK

Tammy Banasek and LaDonna Boeckman, partners with the Chicago office’s professional liability and medical malpractice groups, secured a partial summary judgment for a hospital utilizing Illinois Governor Pritzker’s Executive Order 2020-19, which provided immunity to health care providers, health care institutions, and volunteers who rendered assistance to the State’s response to the COVID-19 pandemic.
