This article provides an overview of distressed sales as well as a brief market snapshot. The authors write, “As a sector, health care entities’ financial troubles are expected to persist and may worsen compared to prior years. Employment Practice Chair Michael Arnold was quoted by SHRM in an article about the FTC’s ban on noncompetes being struck down by a federal court last week. Jeff notes that developers are beginning to structure land deals in ways that mitigate their risk. He says, “You can price the land with an earn-out, where you pay a certain price per acre at closing, and then if and when you get the power the seller gets a post-closing bonus. On August 14, the FTC announced its final rule banning fake reviews and testimonials, which will go into effect on October 21. This rule prohibits the purchase, sale, and dissemination of fake or incentivized reviews and blocks review suppression including the misuse of fabricated social media indicators.
