On Friday, the Nebraska Supreme Court issued its opinions in Fair v. Continental Resources, and Nieveen v. TAX 106, following remand from the United States Supreme Court in the wake of Tyler v. Hennepin County (May 25, 2023). Although the two state court opinions focus on applying Tyler to Nebraska tax sales, the case will potentially impact tax lien foreclosure systems around the country. Most importantly, the opinions impose an additional risk to tax-lien investors: the possibility that they could be liable to homeowners for “just compensation” under the Takings Clause. Matthew A. Many South Carolina court litigators have experienced the frustration of navigating the Palmetto State’s lax standard for the discoverability of expert witness communications and draft reports. However, a recent change to Rule 26 of the South Carolina Rules of Civil Procedure has been updated to better protect expert witness communications. The new section (b)(4)(D) now safeguards interactions between attorneys and experts, aligning more closely with federal standards.
