The U.S. District Court for the Northern District of California sustained, in relevant part, a discrimination complaint filed against Workday, Inc. by an applicant for jobs with employers that allegedly used Workday’s artificial intelligence (“AI”) applicant screening tools. The court’s decision helps delineate the reach of agency and employment agency liability principles for third-party technology vendors in the employment context. The upcoming administration of President-elect Claudia Sheinbaum in Mexico is poised to navigate a complex landscape marked by a need for national unity, fiscal prudence, economic stability, and continuity of progressive policies. Claudia Sheinbaum's election is historically significant, marking the first time a woman has been elected to the presidency of Mexico. However, beyond this milestone, it is essential to understand her political beliefs and the challenges her administration and agenda will face. In particular, the administration must address Mexico's energy and infrastructure needs to capitalize on nearshoring momentum and foster a predictable legal framework that incentivizes and protects investments. As a major player in Latin America and a crucial trade partner to the United States, Mexico's stability and growth under her administration will have far-reaching implications. Her administration's success will depend on its ability to unify the country, manage budgetary constraints, stabilize the exchange rate, address energy and infrastructure needs, appointment of a capable cabinet, navigate AMLO's influence, and effectively manage the inherent risk to stable governance in the revocación de mandato. The World Uyghur Congress (“WUC”) is seeking to raise awareness of human rights abuses affecting the Uyghurs, a Turkic people living in the Xinjiang Uyghur Autonomous Region (“XUAR”) of China. The WUC brought a judicial review claim into the decision by the NCA not to carry out investigations into whether consignments of cotton goods originating from XUAR were the product of forced labour or other human rights abuses carried out by the People’s Republic of China. The dispute in this case focused on the decision by the NCA not to conduct an investigation into potential breaches of law in relation to cotton imported into the UK which had been sourced or processed in XUAR. This alert outlines the implications of the decision. Stuart Alford KC Jumana Rahman Ruth Knox #NCA #humanrights #Uyghur
