A federal court in Missouri issued a final ruling in favor of SIFMA on its legal challenge to two newly enacted Missouri disclosure and consent rules. Read the full release here: https://bit.ly/4ctcRDh The court ruled in favor of SIFMA on all counts and issued a declaratory judgment stating that “the Rules are preempted by NSMIA and ERISA, are unconstitutional under the First and Fourteenth Amendments of the United States Constitution, and are impermissibly vague under the Fourteenth Amendment of the United States Constitution.”

If the U.S. Securities and Exchange Commission intends to continue to rely on CAT data in the future to justify rulemakings, it must create a mechanism for the public to review and evaluate the data in a manner that not only protects the data but also allows for public review of it.
