    ❓: What % of provisional patent applications historically convert to non-provisional utility patent applications? 🅰️ : 35-40% --- A month ago, we filed a FOIA request with the USPTO. We wanted to understand why more people don't file provisionals After all, a provisional patent application: ...costs $60-$300 to file ...has no specific formatting requirements ...buys you a year to convert it to the real-thing You can literally file **anything you want** as a provisional Anecdotally, we'd heard patent lawyers say that more than 90% of provisionals they write for clients end up converting to a nonprovisional 🤯 It seems like a no-brainer for everyone! 🤔Of course, the data is murkier: - Despite the low barrier to filing, only ~150K provisionals are filed each year (compared to ~600K non-provisionals) - Our FOIA request reveals that just 10% of nonprovisional filings come from converted provisional patents We didn't ultimately answer our question (why don't more people file provisionals?) Nevertheless, takeaways could be that: 1. conviction in the invention matters 2. investing in a patent lawyer early builds conviction 3. more conviction = higher willingness to invest in the nonprovisional --- (ask me how Tangify helps startups gain conviction in & write higher-quality invention disclosures in minutes with genAI) cc: Andrew Ryder

    A surprisingly common path to kickstarting a patent process entails: 📢 Talking to a patent lawyer 🤔 Getting an estimate of costs, timeline, and process 🙌 Starting down the path of patent preparation 😢 Getting STUCK and GIVING UP Let's be real - few people **want** to spend their time on patents. The first roadblock is that identifying *what* to secure is already hard. It's more an art than a science. To identify what IP to protect, you need to: -- convey essential context about what your team built & why -- rely on the skill of your IP lawyer ask you the right questions -- trust your IP lawyer's judgment call on different aspects that are protectable The second hurdle is that making forward progress requires lots of back-and-forth with your IP lawyer over several weeks (or months!). A typical pathway is: 📝 Your IP lawyer takes a first pass ❓ They request clarification on the details or nuances of the tech 🙌 They expand out the first draft to include other potential use cases 🤯 They write about each concept in six different ways using language that feels rigid and dense ⌛ They ask you to review dozens of pages for accuracy 😧 You're overwhelmed and have too much going on 🔥 It burns a hole in your to-do list 😒 When you finally review it, it feels disconnected from what you were trying to accomplish in the first place 🙄 You start to question the point of doing all this work in the first place...     I received a question yesterday from a startup founder with over a dozen customers lined up for an MVP...that isn't yet built. "At what stage does it make sense to file patents?" 🤔 In the past, I've suggested filing patents when your value proposition is resonating with customers. Clearly hers is. She rightly pointed out, however, that so much changes as you actually build. So what do you protect? Below are a few questions you can ask yourself to determine if an envisioned product feature is worth protecting: ✅ Is it something your customers want but don't have? ✅ Are you marketing any aspect or derivative of it to your customers? ✅Are customers likely to buy on the basis of you having it or incorporating it into your product? ✅ Is it mission-critical to your product? ✅ Does it solve a technical limitation that prior solutions struggle with? ✅ Does it enable a new capability and/or unlock a new value proposition? As you'll notice, good IP strategy goes beyond filing patents on your technology. It links to everything that matters in your organization - from your GTM motion to your USP to the technical details of your product features. This is something Tangify can help you navigate.     There's a paradox in patent law. You're supposed to file a patent before you publicly disclose or sell your invention. But... - You also need to understand what differentiates 🚀 your solution - To know what differentiates your solution, you need to know why your stakeholders care 🥰 - To know why your stakeholders care, you need to talk 📢 to stakeholders - But if you talk to stakeholders, it could be considered public disclosure 🤔 How do you get around this? NDAs? IP clauses in your contracts? What if you're still in discovery mode? Or figuring out your go-to-market? Or doing things that don't scale? Or fighting for every deal? Or A/B testing specific features? The answer: file something the moment you see customers latching on. You can use Tangify to do it fast, if you want.
