P3s, which have elements of both public and private developments, often operate in a legally gray area.

    As we’ve explained in a prior post, a bid protest is a proceeding where a bidder for a government contract can challenge the government’s selection process or decision. Bid protests generally take place before the contract has been officially…

    Last week, the Rand Corporation, which just completed an analysis of the federal bid-protest system, announced that one thing the federal government has been doing particularly well is resolving bid protests quickly–the majority within 30 days.

    As we’ve explained in a prior post, a bid protest is a proceeding where a bidder for a government contract can challenge the government’s selection process or decision. Bid protests generally take place before the contract has been officially awarded by the government agency in order to give the government the opportunity to consider the issues raised and correct its course if required. Although the government sometimes has the ability to award a contract before resolving the protest–such as in the case of a public emergency–in general, the protest must be resolved first. That means that a prolonged protest delays the award, execution, and performance of the contract.

For example, the cost of the first leg of the Los Angeles light rail system skyrocketed due to the design changes demanded by each of the several municipalities the system was required to traverse. Because the recently proposed expansion of Miami-Dade County’s transit system (the SMART Plan) will…

    Regional mass-transit systems are often plagued by the permitting challenges associated with construction in multiple cities, each with its own priorities, regulations, and permitting processes. For example, the cost of the first leg of the Los Angeles light rail system skyrocketed due to the design changes demanded by each of the several municipalities the system was required to traverse. Because the recently proposed expansion of Miami-Dade County’s transit system (the SMART Plan) will similarly traverse multiple jurisdictions, the project would benefit greatly from consolidated permitting and decision making at the regional level.

    When constructing the original Metrorail mass-transit system, Miami-Dade County addressed the problem of multiple permitting jurisdictions by adopted the “Rapid Transit Zone” (RTZ), which consolidated zoning and permitting jurisdiction for the entire system within the County. Bilzin Sumberg’s Stanley Price drafted the original RTZ Ordinance, and recently, Bilzin Sumberg developed and proposed a value recapture concept to assist with funding community assets such as transit projects. Now this week, the Chairman’s Policy Council, a subcommittee of the Board of County Commissioners, will consider a new ordinance that would ensure that regulatory jurisdiction over the SMART Plan corridors remains with Miami-Dade County, even for areas that are in the future incorporated into new or existing cities. This new ordinance, which follows the recent implementation of a new value recapture transit financing mechanism for the SMART Plan, is another important step towards the expansion of the Miami-Dade County mass-transit system.

Last week, consistent with our recommendation, Miami-Dade County adopted an ordinance that creates a “Transportation Infrastructure Improvement District” in order to capture the added value of new community assets (in this case, new mass-transit corridors) and invest those funds back into the assets. Last week, consistent with our recommendation, Miami-Dade County adopted an ordinance that creates a “Transportation Infrastructure Improvement District” in order to capture the added value of new community assets (in this case, new mass-transit corridors) and invest those funds back into the assets. Districts such as the Transportation Infrastructure Improvement District, remain innovative and appropriate ways of funding existing or new community assets without raising taxes.

Last week, the Board of County Commissioners unanimously approved the new ordinance, which will help the County implement a variety of planned and potential P3 projects in the near future, including the planned Civil Courthouse P3.

Similarly, Miami-Dade County has required since the 1970s that art be provided in the amount of 1.5% of total construction costs for any governmental development, including private development on public land. The County’s program has…

The recently installed floors in Terminal D at Miami International Airport are also a product of the County’s program. I would like to see legislation passed that makes it easier for communities to implement multi-modal transportation strategies through more flexible funding formulas and P3 investment. Also, notwithstanding the current makeup of the Florida legislature, at some point, courageous civilized leadership must…

Also, notwithstanding the current makeup of the Florida legislature, at some point, courageous civilized leadership must prevail to address the abomination that the "Stand Your Ground" law has become, both as written and as applied. How many more people, guilty of absolutely nothing, must be killed by those using the “Stand Your Ground” law as a pretext to murder them before those sworn to serve the public good stop legalizing these killings?

    Burnout must be avoided and there is no one answer to this question. I have learned how to create micro breaks during the day. I also find time to meditate. As for longer breaks and vacations, at present, I avoid the stress of over-programming my vacations. I also attempt to reduce stress by keeping things in perspective. The more intense the moment or issue, the more focused I am on finding a calm manner to communicate the resolution and/or handle the situation.

    Dotson, who leads his firm's land development and government relations practice group, has been involved in the $1.5 billion All Aboard Florida rail system, the $350 million modernization of the Miami Dolphins' Hard Rock Stadium, Hitachi Rail USA's design and manufacturing of a new fleet of trains for Miami-Dade County Transit, Miami-Dade's $3.3 billion contract to stop wastewater discharges in the ocean by 2025 and the Related Group's Liberty Square Rising project. He also helped bring the London-based P3 Bulletin South Conference to Miami.

The upshot: the County has at least nine properties, totaling 22.7 acres of land, that can support over 20 million square feet of new development. Through public-private partnerships (P3s) with developers, the County could leverage these properties to acquire new public facilities and…

    On March 7, the Miami-Dade County Mayor will be presenting a report to the Board of County Commissioners on County-owned properties in downtown Miami that are ripe for joint development with the private sector. The upshot: the County has at least nine properties, totaling 22.7 acres of land, that can support over 20 million square feet of new development. Through public-private partnerships (P3s) with developers, the County could leverage these properties to acquire new public facilities and generate new revenues.

    Due to the massive development potential of these properties, and the flexibility of the P3 model, the County can have its cake and eat it too. The County could, for example, enter into an agreement with a private developer to design, construct, and operate a new public facility on one of these properties–at no cost to the County–and pay the developer with the remaining development rights (for example, a private office tower built on top of a new public building). Under the right circumstances, the County could also receive rent payments, either fixed or a share of revenues, for the private development

    Ranging from revamped retail to public housing centers, the list of developments that promises to transform Miami's real estate landscape extends beyond high-end condominiums.

    Three projects spearheaded by developers were highlighted at the University of Miami Real Estate Impact Conference held Friday in Miami. The panel, titled "Redevelopment Ready: Miami 2.0," was moderated by land use attorney Al Dotson, who leads Bilzin Sumberg's land development and government relations practice group.

    "Today, we can't live with single-purpose destinations like this," said Michael Comras, referring to the two retail centers his company purchased in 2015.

    The Comras Company of Florida Inc. teamed up with Grass River Property LLC and Maryland-based Federal Realty Investment Trust to buy Miami's CocoWalk and South Miami's Sunset Place with plans to redevelop the two retail centers.

In some situations, a bid protest resembles a civil trial and can take weeks or months to resolve, and in other situations it is far less formal and can be resolved rapidly.     Miami-Dade County Commission Approves Incentive-Driven Workforce Housing Ordinance

    On December 20, 2016, the Miami-Dade County Board of County Commissioners approved an Ordinance proposed by Commissioner Barbara Jordan that provides incentives for builders to offer workforce housing units in new developments within the County. The Ordinance addresses the oft-discussed countywide housing affordability crisis by motivating developers to set aside units for families earning 60 percent to 140 percent of the County’s $48,100 median income.

    Commissioner Jordan explained that the purpose of the Ordinance is to provide housing units to police officers, teachers, millennials entering the workforce, and other individuals with similar incomes so that they can live closer to the workplace. Consequently, shorter driving commutes for individuals living closer to their jobs benefit the County as a whole. Shorter commutes translate into decreased traffic congestion, promote neighborhood diversity, and help local employers attract and retain good employees.
