NJ Supreme Court rules tenants can’t file class-action lawsuit in Weehawken high-rise case

The New Jersey Supreme Court Wednesday struck down a group of Weehawken high-rise tenants’ right to file a class-action lawsuit against their management company, ruling that the waiver they agreed to in their lease is valid.

More broadly and far-reaching, the court ruled that the absence of a mandatory arbitration provision in the lease contract -- the basic tenet on which the lower court and appellate court based their decisions -- did not invalidate the class-action lawsuit waiver.
