STATEMENT OF THE HOUSTON ASTROS Houston Astros, LLC, Astros HRSN GP Holdings LLC, and Astros HRSN LP Holdings LLC (collectively the Astros) respectfully state as follows: 1. This evening Houston Baseball Partners LLC (HBP) filed an Original Petition

(the Petition) in the District of Harris County, Texas, against McLane Champions, LLC, R. Drayton McLane Jr., Comcast Corporation, NBCUniversal and Jon Litner (collectively, the Defendants). 2. The Petition asserts causes of action for fraud as to McLane Champions, LLC and

R. Drayton McLane Jr.; negligent misrepresentation as to all Defendants; breach of contract and declaratory judgment as to McLane Champions, LLC; and civil conspiracy as to all Defendants, relating to and in connection with the purchase of Houston McLane Company, LLC and its equity interests by Jim Crane and the current ownership group in 2011. 3. The Astros and HBP refrained from volunteering the prospective filing of the

Petition prior to this filing as Mr. Crane had not yet notified and conferred with Major League Baseball and related interests, among other reasons. However, because the statute of limitations

on certain causes of action the Astros and HBP wish to preserve are set to expire today, the Astros and HBP determined it was necessary to file the Petition in order to preserve their rights. 4. The Astros and Mr. Crane understand and appreciate their obligations under this
