Theappellants,eachofwhomisafemaleperson,seekreviewofajudgmentoftheJefferson
CircuitCourtwhichheldthattheywerenotentitledtohaveissuedtothemalicensetomarry
eachother.
Appellantscontendthatthefailureoftheclerktoissuethelicensedeprivedthemofthreebasic
constitutionalrights,namely,therighttomarrytherightofassociationandtherighttofree
exerciseofreligion.Theyalsocontendthattherefusalsubjectsthemtocruelandunusual
punishment.
ThesectionsofKentuckystatutesrelatingtomarriagedonotincludeadefinitionofthatterm.It
mustthereforebedefinedaccordingtocommonusage.
Webster'sNewInternationalDictionary,SecondEdition,definesmarriageasfollows:
Astateofbeingmarried,orbeingunitedtoapersonorpersonsoftheoppositesexas
husbandorwifealso,themutualrelationofhusbandandwifewedlockabstractly,
the institution whereby men and women are joined in a special kind of social and
legaldependence,forthepurposeoffoundingandmaintainingafamily.

Black'sLawDictionary,FourthEdition,definesmarriageas:
Thecivilstatus,conditionorrelationofonemanandonewomanunitedinlawfor
life, for the discharge to each other and the community of the duties legally
incumbentuponthosewhoseassociationisfoundedonthedistinctionofsex.
Kentuckystatutesdonotspecificallyprohibitmarriagebetweenpersonsofthesamesex1nor
dotheyauthorizetheissuanceofamarriagelicensetosuchpersons.
Marriagewasacustomlongbeforethestatecommencedtoissuelicensesforthatpurpose.For
atimetherecordsofmarriagewerekeptbythechurch.Somestatesevennowrecognizea
commonlawmarriagewhichhasneitherthebenefitoflicensenorclergy.Inallcases,however,
marriagehasalwaysbeenconsideredastheunionofamanandawomanandwehavebeen
presentedwithnoauthoritytothecontrary.
Itappearstousthatappellantsarepreventedfrommarrying,notbythestatutesofKentuckyor
therefusaloftheCountyCourtClerkofJeffersonCountytoissuethemalicense,butratherby
theirownincapabilityofenteringintoamarriageasthattermisdefined.
Alicensetoenterintoastatusorarelationshipwhichthepartiesareincapableofachievingisa
nullity.Iftheappellantshadconcealedfromtheclerkthefactthattheywereofthesamesex
andhehadissuedalicensetothemandaceremonyhadbeenperformed,theresulting
relationshipwouldnotconstituteamarriage.
ThisisacaseoffirstimpressioninKentucky.Toourknowledge,onlytwootherstateshave
consideredthequestionandbothofthemhavereachedthesameresultthatwereachinthis

Wefindnoconstitutionalsanctionorprotectionoftherightofmarriagebetweenpersonsofthe
samesex.
Theclaimofreligiousfreedomcannotbeextendedtomaketheprofesseddoctrinessuperiorto
thelawofthelandandineffecttopermiteverycitizentobecomealawuntohimself.Reynolds
v.UnitedStates,98U.S.145.Wedonotconsidertherefusaltoissuethelicenseapunishment.
Insubstance,therelationshipproposedbytheappellantsdoesnotauthorizetheissuanceofa
marriagelicensebecausewhattheyproposeisnotamarriage.
Thejudgmentisaffirmed.
