    AN ORDINANCE MANDATING EVERY BARANGAY IN THE CITY OF MASBATE TO REQUIRE EVERY HOUSEHOLD TO
    ESTABLISH BACKYARD/ CONTAINERIZED GARDENING AND PROVIDING PENALTIES THEREOF

    Be it ordained by the Sangguniang Panlungsod of the City of Masbate, in regular session assembled, that:

    SECTION 1. TITLE. This Ordinance shall be known as “The Backyard/Containerized Gardening Ordinance of 2020”.

    SECTION 2. DEFINITION OF TERMS. As used in this Ordinance, the following terms shall mean:

    a. Backyard Gardening - refers to a home-farming by applying some scientific or purposeful approach to


    growing food by planting them in the ground.

    b. Containerized or Pot Gardening – refers to the practice of growing plants including edible plants exclusively
    in container or pot instead of planting them in the ground.

    c. Barangay Clearance – refers to a government-issued document and is a requirement for local employment,

    travel abroad, Police Clearance, NBI Clearance, loan application, scholarship application and for other legal
    purposes.

    SECTION 3. ESTABLISHMENT OF BACKYARD/CONTAINERIZED GARDENING – Every household in all the Barangay in


    the City of Masbate is required to establish their respective backyard/containerized gardening and the same
    shall be planted by vegetables or any other crops of their choice.

    A minimum of nine (9) containerized/pot per household is required under this Ordinance.

    SECTION 4. ENFORCEMENT. This Ordinance shall be primarily implemented by the Barangay Officials, Barangay Nutrition
    Officer together with the Barangay Health Workers, and other persons deputized by the Punong Barangay by
    conducting inspection for purposes of gathering data of households establishing backyard/containerized
    gardening during reasonable time and day.

    The Barangay Nutrition Officer together with the Barangay Health Workers shall submit a monthly report to the

    Backyard/Containerized Gardening and those households that failed to establish the said gardening as defined

    SECTION 5. REPORTING PURPOSES. The Barangay Secretary must maintain a record of the list of households practicing
    Backyard/Containerized Gardening and those that failed to establish the same.

    The Punong Barangay shall submit a quarterly report to the City Nutrition Officer, through the Office of the City
    Mayor, the list of households that failed practice Backyard/Containerized Gardening.

    SECTION 6. NON-COMPLIANCE WITH THE REQUIRED BACKYARD/CONTAINERIZED GARDENING. Failure on the part
    of every household to establish their respective Backyard/Containerized Gardening, the Punong Barangay
    through the Barangay Secretary, shall reflect such violation in the Barangay Clearance to be issued to any

    member of the household who is seeking such Barangay Clearance the following: “NO
    BACKYARD/CONTAINERIZED GARDENING”.

    SECTION 7. INFORMATION EDUCATION CAMPAIGN (IEC). The City Agriculturist Office shall conduct Information
    Campaign (IEC) and other necessary activities and support for the proper implementation of this Ordinance.

    SECTION 8. PENALTY CLAUSE. The Punong Barangay who did not reflect in the Barangay Clearance such violation shall
    be subjected to an Administrative Case and shall be subjected to the following penalties:

    1. First Offense - Notification/ Warning


    2. Second Offense - Reprimand
    3. Third Offense - 15-Day Suspension from Office
    4. Fourth Offense - 30-Day Suspension for every succeeding Offense

    SECTION 9. REPEALING CLAUSE. Any provision/s of an ordinance, rules and regulations and/ or any part/s thereof
    inconsistent with the provision/s of this ordinance are hereby repealed and/or modified accordingly.

    SECTION 10. SEPARABILITY CLAUSE. If any provision or part thereof is held invalid or unconstitutional, the other parts of this
    ordinance not otherwise affected shall remain in full force and effect.

    SECTION 11. EFFECTIVITY CLAUSE. This Ordinance shall take effect 15 days after publication in a newspaper with local
    circulation of after posting in three conspicuous public places.
