NOTICE

Sub: Notice under clause 2.3 of the FSA for joint review of relevant clauses pursuant to changein
contracted grade of coal of Block-B CHP/SILO siding (GCNM) w.e.f. 21.09.2021
NCL has signed FSA under NRS linkage auction with different consumers for supply of coal from Block B Project
through Rail Mode. There are around 56 FSA's for coal supply of 3.13 MTPA and coal supplies to these NRS
consumers are being made from Block-B CHP/SILO. The said FSA's are source specific for supply of coal from Block
B Project with existing contractual grade of G 9.

In this connection, it is to inform that competent authority vide communication no. NCL/SGR/Qc/Annual
Gradation/21-22/204, dtd. 18.09.2021 has inter-alia communicated the dispatch point grade of Block-B CHP/SILO
siding (GCNM) for the coal to be supplied by Block-B Project as G-7 (GCV 5201-5500 kcal/kg), W.e.f. 21.09.2021 tilll
further order. The change was also notified to all the concerned by this Office's notice no. NCL/SGR/Mktg./
2109/21-22/786 dtd. 18.09.2021. (Copy of the communications collectively enclosed as Annexure I).

Since there is need for bringing parity as regards to the existing contracted grade of supply as per FSA with that of
declared grade of Block B CHP/SILO, therefore, a joint review under clause 2.3 of the FSA is required in respect of
such provisions of the said FSA on which change in grade structure has a bearing. Upon such joint review, the said
agreement need to be amended in writing to bring it in full conformity in terms of the referred clause of the FSA
wherever required.

In view of the above, all the concerned FSA holders of NRS sector taking coal from Block-B CHP/SILO are notified
through this notice issued under clause 2.3 of the FSA on behalf of seller (NCL) for calling the Purchaser/FSA
holders for a joint review as referred above pursuant to change in grade of coal of primary source (Rail Mode) of
the FSA. A list of purchasers required to sign an amendment to this effect is enclosed with this notice as Annexure
II.

CHP/SIL0 w.e.f. 21.09.20201.
This is for information to all the
customers taking coal by Rail mode from Block B
communication of competent authority vide ref. no. CHP/SILO,
GCNM. in view of the FOIS code -

Gradation/21-22/204 dtd 18.09.2021, regarding the NCL/SGR/QC/Annual

grade of Block B CHP/SILO (FOIS Code GCNM) is tosubject matter, it is to inform that the dispatch point
be considered provisionally as G 7
