    REPUBLIC OF KENYA

    LAND AGREEMENT

    An agreement made this 17th day of January 2019 between DANIEL GAWO OYOO of Identity Card
    Number………………………and of Post Office Box 19, Daraja-Mbili in the Republic of Kenya (herein
    after referred to as the “Vendor” in which expression shall where the context so admit include her
    personal representative, heirs and assigns of one part and FRANCIS ODHIAMBO of Identity Card
    Number …………………..and of Post Office Box Number ……………………in the Republic of Kenya
    (herein after referred to as the “Purchaser” in which expression shall where the context so admit include
    her personal representative, heirs and assigns of other part WITNESSETH AS FOLLOWS:

    WHEREAS:-

    a) The vendor is the proprietor of all that parcel of land Known as KISUMU KAPUONJA/….….and
    situated within Kisumu County (herein after referred to as the “Property”)
    b) The vendor is desirous of selling a portion of the said property measuring …….. by ……… ft.
    upon which a structure shall be constructed for commercial purposes by the purchaser. The
    purchaser shall thereafter pay and buy the same at an agreed price and consideration of Kenya
    Shillings ONE HUNDRED AND FIFTY THOUSAND ONLY (Ksh. 150,000/=)

    NOW IT IS MUTUALLY AGREED AS FOLLOWS:

    1. THAT at the time of execution of this agreement, the purchaser has paid to the vendor the sum of
    SEVENTY THOUSAND KENYA SHILLINGS ONLY (Ksh. 70,000/=) as part payment of the
    purchase price receipt of which the vendor do hereby acknowledge.
    2. THAT the balance of Kenya Shillings EIGTHY THOUSAND ONLY (Ksh. 80,000/=) shall be
    paid by the purchaser to the vendor as agreed between parties herein.
    3. THAT the advocate for the parties herein shall be Mr. Charles Onyango and Co-Advocates –
    P.O.Box 2876 Kisumu.

    4. THAT this agreement shall be deemed to incorporate the terms of the law society standards
    agreement for sale in so for as the said law standard Agreement for Sale (1993 Edition) is not
    inconsistent with any clause herein.
    5. THAT any part of this agreement that shall break any of the terms so as to render this agreement
    incapable of being complete shall pay to the other the sum equivalent to 30% of the total purchase
    price as liquidated damage in addition to refund of any sums already paid if it is the vendor.

    IN WITNESS WHEREOF the parties here to have set the respective hands the day and fear herein
    above mentioned.
