MUBARAT- DEED OF MUTUAL DIVORCE

DIVORCE DEED / MUBARAT NAMA THIS DEED OF DIVORCE IS MADE ON


3rd DAY OF September 2022, (03/09/2022), AT BANGALORE.
Mrs. HAJEERA BANU W/O. SHABBIR, D/O. UBBED ULLA AGED
ABOUT 29 YEARS, PRESENT \B/142 DODIPALYA MAIN ROAD,
SHIVAKUMKAR SWAMIJI NAGAR, KENGERI GOLLAHALLI BANGALORE –
560060.(Herein after called the First Party Wife)

AND

Mr. SHABBIR, S/O. SYED MOHIDDIN ABOUT 32 YEARS, B/142


DODIPALYA MAIN ROAD, SHIVAKUMKAR SWAMIJI NAGAR, KENGERI
GOLLAHALLI , BANGALORE – 560060.(Herein after called the Second Party
Husband)
Whereas the parties herein state that, the Marriage between both the
parties was solemnized on 15/08/2013 at Gulistan Shadimahal at Infantery
Road, Bangalore – 560001 as per Muslim Rites and Customs. The marriage is
an arranged Marriage with the consent of all the relatives of both the parties. It
is submitted that, after the marriage, both the parties No.1 & 2 lived together
as Husband and Wife at Bangalore.

1. Whereas the valid marriage was solemnized between the parties


according to Islamic rites and customas religious wise on 15/08/2013 at
Gulistan Shadimahal at Infantery Road, Bangalore – 560001 and since
then the parties are living as husband and Wife. Since no issue were
born to them out of their wedded lock. As usual wordy quarrel was
accord between them and they were not carried so far marital
relationship between them since 2021 subsequently deserted by both of
them.

2. Whereas the husband and wife decided to dissolve the marriage


solemnized on 30/11/2009 as mutually by getting permanent alumni of
Rs.400,000/-(Four Lakhs Only) by DDbearing DD No. 521523 in favor of
Kareemunnisa payable at Bangalore Drawee Bank, ICICI Bank, RT Nagar
Branch dated 03/02/2022.Same has been acknowledge by the 1 st Part
that all her ornaments provided by bride house is secured with them in
good manner also she undertakes that she has no any claim over jewels,
any immovable property cash Etc. wife further undertakes that all
domestic amenities and appliances provided by bride side taken back as
good condition without any objection of groom side or their parents’ side
on this day of 7th February 2022 and the same has been hereby
acknowledged.
3. Whereas the 1st part hereby assured that she has withdrawn/not press
the complaint lodged by the wife which is pendency of the cases pending
before the court of law in Crime No.217/2021 U/s 3,4,5 and 6 of DV Act
and 498 (A) of IPC now it is on the file of the Inspector of Police JC Nagar
Police Station (previous on the file of the Whitefield Police Station).
4. Whereas now the parties desire to get their marriage dissolved through
this “Mutual Divorce”.
5. Whereas the Wife and Husband agreed to live separately. The husband
forgoing his martial control on his wife or authority on his wife. After
signed this MUBARAT NAMA.
6. Whereas that due to unavoidable circumstances it became impossible for
the both the parties to live with each other, hence on the request of wife,
that she is not ready to forgive her husband and now Mrs.
KAREEMUNNISA Husband named Mr. YOUSUFF KHAN, due to these
unavoidable circumstances she has decided to divorce her husband Mr.
YOUSUFF KHAN, S/O. ABDUL JABBAR KHANand he also shows his
readiness and willingness on the same.
7. The First Party has decided to dismiss or divorce this marital
relationship but because of all the attempts of reconciliation by elders
and well-wishers, the First Party has agreed to continue a matrimonial
life with the Second Party but now there has been an irretrievable break
down of marriage. There is no chance of reconciliation between them in
future. Hence, there is no point for continuance of marital relationship in
future.
8. Whereas in the above said circumstances and also considering the
strained relationship between the parties, the First Party and Second
party, the First Party has decided that there is no point incontinuance of
marital relationship and further agreed upon the dissolution of the
marriage by executing this MUBARAT NAMA. The First Party/ wife is very
much in depression. She is separating herself from her husband through
this MUBARAT NAMA and Second Party also agreed the same.

9. Whereas the reason for this MUBARAT NAMA is that, both the parties are
not willing to continue this relation because their intention is to get
separated from each other. This desire to get away from each other by
giving MUBARAT NAMA, both party blames each other for suffering in
their life after their marriage and for becoming more miserable since
marriage and hence she wishes to get free from this matrimonial relation.
10. Whereas now there will be no relationship between First Party Mrs.
KAREEMUNNISA, W/O. HAJI YOUSUFF KHAN, D/O. T.A. YousuffAli
(late)and there is no more husband-and-wife relation anymore. After
MUBARAT NAMA both the parties are free to take a decision as per their
own will and wishes to do so they can do as per their wish but in future
no Party will blame each other for any issues that arise in their life.
11. Whereas husband is free to marry in future with anyone else for which
First Party wife has no objection and both are free to take their own
decision in their life and no more matrimonial relation between both party
and they are free to take all decision in their life individually and no party
can enter fear in each other personal life.
12. It is further agreed by both the parties mutually that after signing
thisMUBARAT NAMA neither of the parties shall have any right to
interfere in each other personal matter and property issues.
13. Whereas both the party shall file a Mutual Dissolution of Muslim
Marriage Act 1939 suit before the concerned family court forthwith
without any further delay in case of 1 st Party or second Party fail to
appeared before the family court the other party have no any objection by
obtaining Ex-Party order with due process of law.
IN WITNESS WHEREOF THE PARTIES HEREIN HAVE EXECUTED THIS
MUBARAT NAMA IN THE PRESENCE OF THE WITNESSES ATTESTING
HEREUNDER ON THE DAY, MONTH AND YEAR FIRST ABOVE
WRITTEN.
