9. Whereas the reason for this MUBARAT NAMA is that, both the parties are
not willing to continue this relation because their intention is to get
separated from each other. This desire to get away from each other by
giving MUBARAT NAMA, both party blames each other for suffering in
their life after their marriage and for becoming more miserable since
marriage and hence she wishes to get free from this matrimonial relation.
10. Whereas now there will be no relationship between First Party Mrs.
KAREEMUNNISA, W/O. HAJI YOUSUFF KHAN, D/O. T.A. YousuffAli
(late)and there is no more husband-and-wife relation anymore. After
MUBARAT NAMA both the parties are free to take a decision as per their
own will and wishes to do so they can do as per their wish but in future
no Party will blame each other for any issues that arise in their life.
11. Whereas husband is free to marry in future with anyone else for which
First Party wife has no objection and both are free to take their own
decision in their life and no more matrimonial relation between both party
and they are free to take all decision in their life individually and no party
can enter fear in each other personal life.
12. It is further agreed by both the parties mutually that after signing
thisMUBARAT NAMA neither of the parties shall have any right to
interfere in each other personal matter and property issues.
13. Whereas both the party shall file a Mutual Dissolution of Muslim
Marriage Act 1939 suit before the concerned family court forthwith
without any further delay in case of 1 st Party or second Party fail to
appeared before the family court the other party have no any objection by
obtaining Ex-Party order with due process of law.
IN WITNESS WHEREOF THE PARTIES HEREIN HAVE EXECUTED THIS
MUBARAT NAMA IN THE PRESENCE OF THE WITNESSES ATTESTING
HEREUNDER ON THE DAY, MONTH AND YEAR FIRST ABOVE
WRITTEN.
