fundamental logic, rationale and SEB Rule that we submit this complaint.

Fulton County provided Election Day poll closing tapes in response to an Open
Records Request. From those records we were able to ascertain that 58 of the Election Day
poll closing tapes were unsigned (A true and correct copy of the unsigned Election Day poll
closing tapes are attached hereto as “Exhibit A”; A true and correct copy of the certification
from the Fulton County Custodian of Records is attached hereto as “Exhibit B”). The
aforementioned is in direct violation of:
Ga. Comp. R. & Regs. 183-1-12-.12 The poll manager and the two witnesses shall cause
each ballot scanner to print three tapes of the tabulated results and shall sign each tape
indicating that it is a true and correct copy of the tape produced by the ballot scanner. If the
poll manager or the witnesses have reason to believe that printed tapes are not a true and
correct tabulation of the ballots scanned by that ballot scanner, the poll manager or witness
shall document the reasons and evidence for that belief and inform the election
superintendent, who shall take appropriate action, in his or her discretion, so that the ballots in
the ballot box associated with the ballot scanner are accurately tabulated.

For violation of the State Election Board Rules and Regulations detailed above, we are seeking
the following relief:

1. Seek and provide alternate authentication for the results of the unsigned ballot scanner poll
closing tapes in the form of paper ballots, recap sheets, etc.
2. Order Fulton County to amend and recertify their election results to reflect those ballot
scanner poll closing tape results that cannot be verified.
3. Amend the SEB Rules and Regulations to reflect a proper penalty for future violations.

After reviewing the aforementioned request, we believe we may have responsive records. As permitted by
O.C.G.A. § 50-18-71(c), a fee will be charged to cover the administrative costs associated with the time spent
searching for, retrieving, redacting, and supervising access to the requested documents. The fee represents the
hourly rate of the lowest paid full-time employee(s) with the necessary skill and training to respond to your
request. However, no charge will be made for the first fifteen minutes of staff time expended in complying
with your request. Unless otherwise provided by law, the charge for copies is generally $0.10 per page, as
permitted by O.C.G.A. § 50-18-71(c).

Because this amount is in excess of $500, we will delay producing said records until such time as you pay the
estimated costs. You may do so forwarding a check, payable to Fulton County, to the attention of Steven
Rosenberg, at the address above. The estimated cost for search, retrieval, and copying of the responsive records
is $15,800.00. This amount includes the following fees listed below:

Advanced voting poll tapes was done for a previous request and these will be uploaded as soon as they are
located.
L&A Testing polls tapes will be at a cost for personnel for completions.
