RULE I. TITTE

These Rules ond Regulotions sholl be known os the lmplementing


Rules ond Regulotions of Republic Act No. I 1589, otherwise known os the
"Bureou of Fire Protection Modernizoiion Act".

RULE II - DECI.ARATION OF POLICY


It is ihe policy of the Stote to ensure public sofety through the
prevention ond suppression of oll kinds of destructive fires, with the octive
support of ihe community. Towords this end, the Stote sholl formuloie ond
implemeni plons ond progroms to enhonce ond modernize the Bureou of
Fire Prolection, expond ils mondote ond copobilily ond ensure ils
responsiveness io the chonging needs of the community.

RUTE III - DEFINITION OT TERMS

Protection (BFP) pursuont to Section 5.1.1.9 of the IRR
of Republic Act No. l 1589.

the Bureou of Fire Protection Modernizolion Progrom

direclion. lt includes the estoblishmeni ond provision
of bosic fire proieclion equipment, copobilily
building qnd enhoncement progrom for BFP Service,
ond lhe odoption of Artificiol Intelligence ond

in the implementotion of the project/progroms, the

BFP Personnel. This refers to the uniformed personnel, both

purpose.

Fotol Fire. Fotol fires ore fire incidents involving deoths ond injuries.
lnvesligotion on fotol fires would involve
delerminotion of the origin ond couse of fire ond/or
explosion, os well os, the cquse ond monner of such
deoth or injury.

Fire ond Arson lnvestigolor. This refers to on individuol with the skills
ond knowledge necessory lo conduct, coordinote,
ond complele (forensic grode ond science bosed)
fire invesligotion.

Fire Loborolory. This refers lo the stote-of-the-ort loborotory thot
provides scientific ond professionol service to the Fire
ond Arson lnvestigotors in determining the couse of

Fire Sofety Complionce Report (FSCR). This is o written report


composed of plons, specificotions ond design
onolysis per building prepored by iis
Engineer/Architect-of-Record ond Fire Sofety
Proctitioner.

Fire Sofety Proctilioner. A fire sofety proctitioner refers to ony


quolified person, recognized by the BFP, engoged in,
but not limited to, the design, construction,
instollotion, repoir ond mointenonce, ossessment,
ond rehobilitotion of fire sofety construction,
suppression ond conlrol systems, protective ond
worning systems ond life sofety-reloted services, or
employed os o sofeiy officer of public ond privote
esloblishments/compo nies.

Forest ond Gross Firefighting. (olso known os wildlond firefighting).


This refen to firefighting thot involves weeds, gross,
field crops, brush, forests, ond similor vegetotion

Forest Fire. A forest fire is ony uncontrolled ond non-prescribed


combustion or burning of plonts in o noturol setting
such os forest, grosslond, brush lond or lundro, which
consumes the noturol fuels ond spreods bosed on
environmenlol condiiions.

Frequency of Fire lncident. This refers to o condition in o porticulor


locolity thot describes how often fires breok out.

Hozordous Moteriol (HAZMAI). This is o chemicol or substonce thot is

by the BFP.

5.4.2. Estqbllshmenl of the Securlty ond Prolecllon Unlt (SPU). The BFP
sholl estoblish o Security ond Protection Unii (SPU) solely
mondoted to protect every BFP personnel in the performonce
of criiicol f unctions.

5.4.2.1. Dulles ond Funcllons. The SPU sholl undertoke its

The BFP moy enter into multi-yeor conlrocts or other controcluol


onongements with locol or foreign suppliers ond controctors in the
implementotion of this Act, pursuont to the BFP Modernizotion Progrom,
Projects ond Appropriotions. opproved by Congress, subject to the
opprovol of the President, the provisions of existing lows ond regulotions
including lhose of the Commission on Audit ond under such terms ond
conditions most fovoroble to the Government.

Multi-Yeor Controcts (MYC) ore those controctuol onongements


entered into for the purpose of securing or obioining Multi-Yeor Projects
(MYP).

Multi-Yeor Projects (MYP) refer to budgetory


progroms/projecis/octivities which will toke more thon one ('l ) yeor lo
compleie ond require multi-yeor oppropriotions.

The Congress sholl, upon issuonce of o Multi-Yeor Obligotionol


Aulhority by the DBM for multi-yeor controcts, moke the conesponding
oppropriotion for the ensuing fiscol yeors: Provided, thot the BFP ond lhe
DBM sholl jointly issue policies lo ensure consislency with the BFP
Modernizolion Progrom ond existing guidelines in the conlrocting of multi-
yeor projects.

Mulii-Yeor Obligotionol Authority (MYOA) is the document issued by


DBM, either for locolly funded projects (tFPs) or foreign-ossisted projects
(FAPs) implemented by ogencies, in order to outhorize the lotter to enter
into MYPs for the full project cost.

SEC 8. BFP MODERNIZATION TRUSI FUND

8.1. 8FP Modernkollon Trusl Fund


The trust fund creoted pursuont to Section l3 of RA No.95l4
sholl be renomed os the BFP Modernizotion Trust Fund refened lo
under RA No. I 1589.

The BFP Modernizolion Trust Fund, in occordonce with existing


government budgeting, occounting ond ouditing rules ond
regulotions, sholl be used exclusively for the implementotion of the
BFP Modernizotlon Progrom os provided for under RA No. 11589. This
sholl include oll expenses necessory for the procurement of focilities.
mochineries, equipment ond services os well os repoirs, moinlenonce
ond improvements. However, this sholl not cover the solories ond
ollowonces of BFP Personnel which is opproprioled under Generol
Appropriotions Act (GAA). As such, the BFP sholl continue to pursue
its mondote of implementing progroms ond projecls from the regulor
GAA oppropriotions ond from funds under the Trust Fund.

8.2. Administrollon of BFP Modernlzolion Trusl Fund. Pursuont to Section 7


ofRA No.'l 1589, the BFP Modernizotion Trust Fund sholl be
odministered by the Chief, BFP in occordonce with existing
government budgeting. occounting ond oudiling rules ond
reg u lotions.

8.4.2. Toxes, Fees ond Flnes Collected Pursuonl to Republlc Acl No.
9514.

This pertoins to
Code Revenues stoted under Speciol
Fire
Provision of the Generol Appropriotion Act sourced from eighty
percent (80%) of lhe toxes, fees ond fines collected in
occordonce with Section 13 of R.A. No.9514. The releose of
funds sholl be subject to lhe submission of o Speciol Budgei
Request.

8.4.2.1 Collecllon qnd Remlllonce. The LGUs moy ossess


ond collect ordinory fire code fees os moy be outhorized
ihrough o Joinl Memorondum Circulor to be issued by the
DILG. For this purpose, the LGU sholl turn-over one hundred
percent (100%) of the ordinory Fire Code Fees collected to the
locol fire stotion, which sholl in lurn remit the some in
occordonce with RA No. 11032 ond other reloted lows ond
regulolions. The locol fire stotion sholl ensure thot the one
hundred percent (100%) of the soid Fire Code fees collected
sholl be remitted to the BFP Modernizotion Trust Fund. The
determinotion of the 80% BFP shore ond the 20% IGU shore in
the Fire Code Fees collected sholl be in occordonce with
exisiing government budgeting, occounting ond ouditing rules
ond regulotions.

The BFP sholl develop on oppropriote online system


should it shift into full outomotion in the monner of ossessment,
collection ond remittonce of ordinory Fire Code Fees. The
system to be developed sholl conform fo relevqnt lows ond
reg u lotions.

8.4.3. Proceeds from the Disposol of Excess ond Uneconomlcolly


Repoiroble Equipmenl ond Olher Movoble Assels ol the BFP

or no future economic benefits or service potentiol is

expected from its use or disposol ond if found to be voluoble
moy be sold ot publlc biddlng or ot o negotioted sole in the
event thot public blddlng folls.

The Disposol Committee sholl recommend to the heod of


the ogency the proper mode of disposol. Property moy be
disposed through oppropriote modes os provided under
pertinent lows ond regulotions os moy be deemed most
odvontogeous to the government. Proceeds from the disposol
of the properties sholl be deposited directly to the BFP
Modernizotion Trust Fund.

8.4.4. Funds hom ony budgetory surplus, os moy be oulhorized by


Congress

Budget Surplus refers lo the cumulotive results of normol


ond continuous operotions of the Notionol Governmenl
including prior period effects of chonges in occounting policy
ond enors, ond other copitol odjusiments os moy be
outhorized by Congress. When government income exceeds
government expenses or when iox revenue is greoter thon
government spending.

ln relotion thereto, instonces where there is o budgel


surplus, Congress moy enoci lows to provide omounts to be
used for the BFP Modernizotion Progroms.

8.4.5. loons/Gronls/Donollons lrom locol ond Forelgn Sources lo be


Utllized ln the BFP Modernlzollon Trusl Fund

The BFP moy occept donotions, contributions, gronis,


bequests ond/or loons, in cosh or in kind, from vorious sources,
domestic or foreign, for the BFP Modernizotion Progrom.
Provided thot, in cose of donotions from foreign governments,
ond occeptonce thereof, it sholl be subject to the prior
cleoronce ond opprovol by the President of the Philippines
upon recommendotion of the Secretory of Foreign Affoirs ond
sholl conform to lhe government budgeting, occounting ond
oudiling rules ond regulotions for foreign donotions.

Receipts from donotions sholl be occounted for in the


books of the donee-government ogency in occordonce with
pertinent occounting ond ouditing rules ond regulotions. Such
donotions incosh sholl be
deemed outomoticolly
opproprioted for the purpose specified by the donor. The
receipts from cosh donotions or its equivolent sholl be

deposited with the Notionol Treosury ond recorded under the
BFP Modernizotion Trust Fund.

There sholl be no donotion whether from internotionol or


locol source, unless o formol occeptonce for the purpose is
issued by the Chief. BFP or his outhorized representotive.

Cosh donotions sholl be used for ocquisiiion of items


thot ore necessory for upgroding of the BFP services which ore
oligned to the progrom ond thrusts of the BFP Modernizotion
Progrom, or for specific purpose/s consistent with
modernizotion.

All income from gronts ond donoiions sholl be


opproprioted os trust receipts ond sholl be remitted under the
BFP Modernizotion Trust Fund.

Receipts from donotions, whether in cosh or in kind, sholl


be occounled for in ihe books of the donee-ogency in
occordonce with occounting ond ouditing rules ond
regulotions. The receipis from cosh donotions ond proceeds
from sole of donoled commodities sholl be deposited with the
Notionol Treosury ond recorded os BFP Modernizotion Trust
Fund, ond sholl be ovoiloble to the implementing ogency
concerned through o Speciol Budget pursuont to Section 35,
Chopter 5, Book Vl of E.O. No. 292. The cosh volue of the
donotions sholl be deemed outomoiicolly opproprioted for the
purpose specified by the donor. Donotions with o term not
exceeding one (l) yeor sholl be treoled os port of the trust
fund.

All donotions in cosh sholl be supported by the required


documents. including controcts/ ogreements if there ore ony,
ond sholl conform to existing lows or policies ond guidelines.

8.4.6. All lnleresl lncome lhol Accrues lo the Irusl Fund. ln ony event
thot the trust fund occrues interests, it sholl form port of the BFP
Modernizotion Trust Fund.

fund regordless of income source sholl not be subject to ony ceiling
by the DBM.

SEC. 9. tOCAt EQUIIY lN THE 8FP MODERNIZATION.City ond Municipol
governments sholl be outhorized to use their respective shore from oll
toxes, fees ond fines collected pursuont to RA No.9514, for the following
purposes:

l. Operotionol ond Mointenonce of locol fire stoiions ond offices.

For this purpose,operoiionol ond mointenonce of locol fire


stotlons moy include instollotlon of bosic utilities, provlsion of
service vehicles, office supplles, physicol fitness focilities ond
equipment omong others.

o Construction, repoir, rehobililotion, renovotion, restorotion ond


improvement of locol fire stotions, focilities, offices ond its
oppurtenonces.

Acquisition
offices including demolition of existing building for
construction/repoir or renovotion.

The LGUs moy donote lot/s for the estoblishment of locol


fire stotion ond offices. ln oddition to this, they moy olso instoll
street lighting system ond construct roods leoding to locol fire
slotions.

4 Acquisition or instollotion of firefighting equipment including fire


trucks. fire bools. oeriol lodders ond ombulonces.

( Procurement of personnel prolective equipment, self-conloined


breolhing opporoius ond other firefighting tools ond
investigotion equipment.

6 Oiher relevont progroms, projects ond octivities os moy be


identified by the BFP in occordonce wlth Seclion 4, subsections
(o), (c), ond (d) of RA No. 11589.

Locol Government Units sholl be outhorized to implement


development progroms qnd projects complementory ond
supplementory to the BFP Modernizolion Progrom, to be chorged
ogoinst the ollocolion for locol development projects os provided in
Seclion 287 of RA No 7l60, os omended. Provided, thol development
progroms ond projecls implemented by LGUs in occordonce with this
Act sholl be included in their respeclive locol development plons ond
onnuol investment progroms.

SEC.10. PERIOD OF IMPIEMENIATION. The BFP sholl implement the


Modernizotion over o period of ten (10) yeors effective upon the dote of
the opprovol of this Act. Provided, however, thot poyment for

omortizotion of outstonding multi-yeor controcls ond obligotions incuned
under the modernizotion progrom moy extend beyond ihis period.

SEC. II. STRICT APPTICATION OF EASE OF DOING BUSINESS AND EFFICIENI


GOVERNMENT SERVICE DETIVERY ACT OF 2OI8

ln oddition to the provisions of RA No. 95,l4 ond its RIRR, the BFP sholl
likewise strictly implement RA No. 11032 ond its implemenling rules ond
regulotions in the processing of ony opplicoiion or renewol of fire sofety
permits, cleoronces ond certificqtes.

Any low to the conlrory notwithstonding, o fire sofety inspection


certificole sholl nol be required for the processing ond opprovol of locol
business permits for professionols, freeloncers, self-employed persons,
individuol controctors, ond one-person corporotions who ore engoged in
service octivities ond who registered their respective residences os their
principol ploce of business.

SEC. 12. CONGRESSIONAT OVERSIGHT COMMITTEE

There is hereby creoted o Joint Congressionol Oversight Committee


composed of four (4) Senolors ond four (4) Representotives oppoinied by
the Senote President ond the Speoker of the House of Representotives,
respectively. The Oversight Committee sholl be co-choired by the
choirpersons of the Senqte Commitlee Public Order ond Dongerous Drugs
ond the House of Representotives Commitlee on Public Order ond Sofety.
The Minority sholl hove ot leost one (l) representotive from eoch
Chomber.

The Oversight Commiltee sholl monitor ond oversee the


implementotion of the provisions of this Act. lt sholl odopt its iniernol rules
of procedure, conduct heorings ond receive testimonies, reports, ond
technicol odvice, invite or summon by subpoeno od festil'icondurn ony
public officiol or privote cillzen to testify before it, or require ony penon by
subpoeno duces fecum documents or other moleriols os it moy require
consistent with the provisions of this Act. Provided, thot within five (5) yeors
ofter the effectivity of this Act, or os the need oriscs. the Congressionol
Oversight Committee sholl conduct o sunset review ot this Act. The term
'sunset review' sholl meon o systemotic evoluotion of the
occomplishments ond impoct of this Act, os well os the performonce ond
orgonizotionol structure of its implementing ogencies, for purposes of
determining rcmediol legislotion

SEC. 13. APPROPRIATIONS. The omount necessory to implement the


provislons of this Act sholl be sourced from the BFP Modernizotion Trust
Fund os provided in Section 7 of RA No. 11589. ln oddition, lhe onnuol
oppropriolions for ihe BFP Modernizotion Progrom sholl include the
omount necessory to support the funding requirements for oll
modemizotion projects submitted toCongress. The f unds be to
opproprioted to implement the provisions of this Act sholl be included in
lhe Generol Appropriotions Act under the BFP.

not otfected sholl remoin volid ond subsisting.

SEC. 16. REPEALING CLAUSE. Section 54 of RA No.6975, os omended ond


Sections 5. l2 ond l3 of RA No.9514 ore hereby omended or modified
occordingly. All oiher lows, decrees, ordinonces, rules, regulotions, other
issuonces or ports thereof which ore inconsislent with the provisions of RA
No. I 1589 ore olso hereby repeoled, omended or modified occordingly.
