Chief Hetrick informed me we received a report of an alleged hazing incident that occurred in the city, off of the
Bowling Green State University (BGSU) Campus. A member of the BGSU hockey team reported to the BGSU Dean of
Students that there was a Hazing incident involving members of the hockey team. I was provided the name of the
student, Austen Swankler, who reported the hazing incident.

I contacted Swankler on 9/18/23 and arranged to speak with him at BGPD. Austen met me at BGPD around 6PM on
the same date and we spoke in an interview room. He explained he came to BGSU to play hockey. He told me he
entered the transfer portal this morning and already received a call from Penn State to recruit him. He told me he talked
with the coach about leaving earlier this season to pursue an NHL contract, though "Eigner" (BGSU Hockey Coach)
took him to lunch and encouraged him to stay. As a result, Austen decided to stay at BGSU, though when "all this
happened" he decided to enter the portal to play elsewhere. He told me that as a result of his transfer, he would not be
able to play half of the season, but felt it was "better for me mentally..."

Austen expressed concern about having his name involved in this report. He explained he went to BGSU personnel to
address the hazing concerns and did not intend for there to be a criminal investigation. He said he does not want to be
labeled as a `snitch,` but noted he wanted to do the "right thing" by disclosing what occurred. He explained the `hockey
culture` is tough for players to manage. He noted if players don`t go along with the activities, they are often ridiculed or
chastised for not partaking. He also expressed a fear of retaliation by those involved.

Austen then explained what occurred. He told me that the events which occurred are a "tradition" at BGSU and
believes this has occurred well before he attended BGSU. He said he "was hazed" his freshman year (2021) and
explained the freshman are the focus of the hazing every year. He noted his freshman year, the event occurred later in
the year due to COVID, though the tradition typically occurs before the season starts. When he was a freshman in 2021,
he recalled this event, which he referred to as "rookie day," started at the freshman house on Leroy Ave. (Bowling
Green, Ohio). The freshman knew when "rookie day" was going to occur, though were unsure of what was going to
transpire aside from drinking heavily.

He said they were told to pack bags and run throughout BGSU campus. He noted they received text messages from the
seniors with different locations to run to. He said they were eventually directed back to the hockey houses (he later
described the 4 houses in the 900 block of Fourth St, Bowling Green, Ohio which face south) at which time they were
blindfolded and tied-up and driven to a different house. He said they were given white shirts with "different terms-
racial and whatever they could come up with…" with a Smirnoff Ice drink underneath. They are given the Smirnoff
with the expectation that they will get on one knee and chug the drink (referring to as being "iced"). Austen said they
told the freshman to drink it and said, "you feel like you have to" drink the Smirnoff drink. He then said they were told
they "don`t have to" drink the Smirnoff, but the tone of the event was that they were expected to drink it. He said
everyone drank the Smirnoff.

Austen said they then put blindfolds back on and were "poking us with sticks and stuff like that." He said there

was also a senior who punched another senior in the face and snorted a line of powder, which they believed to be
cocaine at the time. Now that he is older, he now knows the powder was vitamin B12 that they snorted. He said they
were again blindfolded and driven back to Fourth Street where they would have them do a "wall sit (exercise) and do a
handle of alcohol" which they split amongst the freshman. He said they "chugged" the liquor and the expectation was
for them to finish the handle (clarified to be a 1.75 liter bottle of alcohol) of alcohol while they were doing the "wall
sit." He believed the liquor he and his freshman teammates drank was Captain Morgan. Austen estimated he took 7-8
shots of liquor during this short period of time. He believed there were 8 freshmen in his class. He said they then
played drinking games with beer, which typically resulted in the freshman vomiting. Austen explained many of the
freshman were "put to bed" upstairs due to their level of intoxication. He recalled having been "put to bed" after these
games during his freshman "rookie day."

Austen told me he did not experience what occurred after that, but has heard that the freshmen are then given the option
to pick a cucumber or lipstick. He said, "either getting a cucumber up the butt or like, kissing somebody`s private part
or something like that." He noted he did not experience this, however, teammates often reference it in their group chats.
He articulated several times that he did not experience this first-hand.

Austen told me he brought the events to the attention of his coach ("Ty") last year (Austen`s sophomore year) when he
was contemplating leaving the team. Austen told him "I don`t want this stuff happening next year, I don`t want the
guys to drink…" to which the coach told him they would handle it "next year." I clarified he was referring to Coach Ty
Eigner. He said when he brought it up to the coaches, his teammates did not appreciate him doing so. He recalled an
argument with a teammate on the ice when the coaches were standing near them. The other player said he wanted to
change the culture, to which Austen challenged whether they truly wanted to change the culture when they still had
freshman drinking at "rookie day." He noted the coaches were standing nearby, but did not say anything. He clarified
that confrontation occurred this year (2023) before "rookie day" occurred. Austen added that his teammates began to
treat him differently after this. He said he talked to the coaches about "rookie day" on a different occasion as well (this
year). He said the coaches encouraged him to "be there to be part of the team" and to help take care of his teammates.

Austen said he attended "rookie day" this year (later determined to be September 2, 2023) but he did not engage in any
of the activities. He noted he got several guys water who seemed to be struggling with consuming the alcohol. He
noted one freshman (later identified as Nick O`Hanisain) was having a hard time drinking and looked over at him
(Austen), so Austen drank for him. I asked how the teammates responded to that. He said they told him that it wasn`t
his day. He said during "rookie day" of his sophomore year he spent most of the time upstairs with the freshman who
were vomiting from drinking and making sure they were laying on their sides. He recalled talking to his parents about
what was taking place and said he felt "scared the past few years" that something would happen if he didn`t say
something about what was taking place. He expressed relief since he has since shared these experiences.

I asked who else Austen thought I should talk to. He recalled one occasion when Jaden Grant and Cole Moore were at
his girlfriend`s house and he told them he wanted to talk to the coaches and the older guys so they would not have to
drink at "rookie day." He told me last year (Austen`s sophomore year) Jaden was forced to drink milk as he refused to
drink alcohol. He also recalled they did not make one player drink at "rookie day" (Michael Bevilacqua) as he recently
had a kidney operation. He said since he has talked with his coaches about the drinking, one of his teammates pointed a
pellet gun at him. He did not feel threatened, though was confident the guy did not like him and was trying to
intimidate him.

He noted he has not been happy at BGSU since he came back. I asked who the seniors were this year, to which he
replied (Ethan) Scardina and (Seth) Fyten. He referred to them as having been "in charge." He explained they hosted a
meeting the day before "rookie day" to explain what other teammates roles would be during "rookie day." The meeting
consisted of sophomore, juniors, and seniors. He also mentioned that Seth (Fyten) had a taser this year and was tasing
freshman when they were on the ground blindfolded and tied-up. He also said the blindfolds were the hockey socks
from the rink.

I clarified that Austen talked to his coach his sophomore year and expressed his concern about the forced drinking, and
that the coach`s response was that Austen should talk to the older guys. Austen again referenced Jaden Grant refusing
to drink- he said he declined being "iced." I asked how the teammates responded to that. He recalled the teammates
saying "fuck you" to Jaden and took the drink from him. He then had to drink a jug of milk through the duration of the
event.

Austen said no one on the team would talk to him after he talked to the dean of students about this event. He said he
was removed from all the group chats and his friends haven`t responded to his messages since last Friday when a coach
and players were suspended. I asked what means they used to chat, to which he responded Snapchat. I asked if they
had a group name, though it was a thread with all the teammates (no group name). Austen again noted his intentions
were only to get the hazing to stop. He did not wish for anyone to be fired or charged criminally. He described the
culture of the hockey team to be "toxic" and "terrible." Austen explained he was successful last year, yet he found his
skate laces cut, inferring that his teammates were sabotaging his gear. He said he brought it to his coaches` attention,
however, it continued to happen.

I asked him if he had anyone on the team`s Snapchat user names. He recalled sending Scardina a message on Snapchat
telling him he did not want freshman to drink this year. He provided me Scardina`s user name as "ethansscar".

On 9/20/23 I spoke with Austen again. I asked him to describe at which house on Fourth Street "rookie day" occurred.
He explained that from the perspective of facing the houses from the street, the senior house is the farthest to the right
(eastern-most house in the 900 block). He was unsure where they were blindfolded and tied as he was not there. I
asked about where the "wall sit" drinking occurred. He said between the 3rd and 4th house

(two eastern-most houses), but they played drinking games in the 3rd house. He was unsure if anything occurred in the
4th house.

I asked him where the cucumber/ lipstick event occurred, he believed it was at 909 Fourth, but he was not present. He
believed the house numbers were 901, 909, 917, and 927 Fourth Street (he was uncertain on the numbers). Using the
Wood County Auditor`s webpage, I found the houses in this block to be 901, 909, 917, and 925 Fourth Street. I asked
what he did observe. He said he was present when the freshmen were driven into the garage of a house across the street
from Carter Park. He described it as an older house with a windmill that was not near other houses, and was behind a
lone parking lot across from the park. He said this is where the seniors snorted the vitamin B12, acting as though it was
cocaine, then told the freshman to do the same. I asked if they thought they were snorting cocaine, which he confirmed.
I asked which senior punched the other and he believed it was Spencer Kersten who punched Seth Fyten. Austen said
he went back to Fourth Street. He did not go inside either house and watched the events that occurred outside. Austen
went home after they played the drinking games and the freshman were put tot bed. He was not present for the
cucumber/ lipstick portion, but believed it occurred at 909 Fourth.

He explained after that they have the freshman sing the fight song, and order them pizza. I asked if he saw any
cucumbers or lipstick. He said he saw two cucumbers on the island (kitchen) in the house. I again asked who was
using the taser, to which he replied Fyten. He said Fyten resides at 927 Fourth. I asked if he was aware of anyone
keeping any memorabilia from "rookie day." He said the freshman may, but otherwise was not sure. He believed the
freshman lived on Second Street, though did not recall the address.

On 9/22/23 at approximately 2PM, Det Robinson and I spoke with Jaden Grant, who is a member of the BGSU Hockey
Team. I explained to Jaden we were looking into the alleged hazing incident forwarded to BGPD. Jaden was unsure
what the particular event was, but told me he believed the report was made by an individual out of anger and he "wanted
to retaliate" against the team. He noted he has played with Swankler since he was 16 and said he "likes conflict with
people." Jaden said Swankler contacted him via phone and told him the coaches were going to punish him for stealing
something from the equipment room. Swankler text him soon after and told him he was going to the dean`s office. The
team then noticed he was saving pictures of the team`s chat on Snapchat. He no longer had the content of the chat as
Snapchat conversations disappear after 24 hours.

Jaden told us Swankler has a "bad reputation" in the hockey community, though since Jaden had known Swankler
longer then others, but wanted to support his teammate. He recalled prior discussions about Swankler in which others
referred to him as "a cancer" to the team and whether he should still be on the team. He talked about how the team
worked with professionals on team-building and determined standards the team wanted to abide by which were
toughness, discipline, and integrity. He noted part of that included personality accountability. Jaden noted several
instances in which Swankler had conflicts with other players. He noted when other players tried to hold Swankler
accountable, he did not handle the feedback well. Jaden noted Swankler spoke openly about wanting to transfer to a
different program, which Jaden felt should be a private conversation Swankler should have had with the coaches.

Jaden referenced "rookie week" which he described as "fully optional" and "voluntary" which he suspects Swankler was
using to get back at the team. He said seniors organize the week, but make it known that the events are optional. He
did not consider it "hazing" as the activities are optional. He added that the coach "preached" to them in team meetings
that the events are optional and told them if they did not want to participate, they did not have to. Jaden said he
participated in his "rookie week," though was not in town the weekend of the event this year. He noted there are some
drinking games involved, but he does not drink alcohol during his "rookie week" and no one made him feel
uncomfortable for not drinking. He noted there are other players who did not participate due to medical reasons, which
was accepted by the rest of the team. He added "rookie day" is typically a Friday or Saturday to bring the week to a
close.

Jaden noted although he was not in town for "rookie day" he has two freshman roommates and recalled assuring them
they would be safe (the freshman were unsure of what was to be expected). He recalled during his "rookie day" that
they were asked if they wanted to be blindfolded and taken to a different location, which he agreed to. He said they
were taken to a garage where they were greeted by other teammates, and when the blindfolds were removed they saw a
mirror with a powder on it and they asked the freshman if they wanted to "do this" (referring to snorting the powder
from the mirror). He said they assured them they "were fine" and a were told by other teammates that they didn`t have
to do it, inferring they were telling them it was safe. He said they again gave them the option to do it. Jaden said he
declined, and there was no push-back from the team. He said they told him it was not cocaine and was actually a
powdered vitamin. He said "they gave me no issues with that." Det Robison

asked if he was asked to do anything else since he did not drink alcohol. Jaden told us they asked if he wanted to drink
milk instead, which he did until he chose to stop. He noted that occurred during a drinking game, but when he did not
want to drink it any more he threw it in the trash. I asked about the wall sit. He noted he did not participate, but his
classmates did a wall sit exercise and passed the bottle down the line as each drank from the bottle. He recalled some
people at the end did not get to drink any as the ones before drank most of the bottle. He again noted that before each
event, they (upperclassmen) told them "hey, if you don`t want to do this, just step aside." He was unsure what kind of
liquor or drink was in the bottle they passed.

I asked what else occurred that day. After the wall sit, he said they celebrated and welcomed the freshman to the team.
They had a party later in the night and some people went out to the bar. He said everyone typically hangs out around
the hockey houses on Fourth Street. I asked Jaden if there was any mention of a cucumber or lipstick, which he
confirmed there was. He said it occurred later in the day. The older teammates called freshman into a room one-by-one
and had them choose between the cucumber or lipstick. Jaden asked what would happen if he chose the cucumber, to
which they asked if he would "stick this cucumber up your butt" which he declined to do, and he chose the lipstick. He
said they began laughing and told him to leave the room. Jaden described the day as "fun and jokes" and during this
exchange, the players present were laughing and he did not believe they were serious about expecting him to insert a
cucumber in his anus.

I asked if he declined to participate in any events during the day if he felt there would be any negative repercussions,
which he did not. He explained before coming to college, he was concerned there may be traditions for new members,
though since coming to the team, he has not felt that concern. He noted they told him they respected him for "sticking
to his guns," which made him feel better about the team. He said as a result of this he felt closer to the older teammates
who respected his decision to not drink. I asked if there was anything else that occurred that made him feel
uncomfortable. He said the idea of "rookie week" was initially intimidating due to being referred to as "rookie week"
but noted everyone is included and "they give you the option" to be involved as much they chose. He noted he did not
keep his shirt from "rookie day" and believed his said "Mr. No Fun" on the shirt. He said the names were agreed upon
between the freshman and older players.

He recalled the message they received from coaches and older players was to have accountability and felt that Austen
did not want to take accountability for his actions and as a result, wanted to "hurt" the team. He said he has not had
contact with the seniors who were suspended or his coach at the direction of BGSU personnel. He also has not had
contact with Austen for the same reason. Jaden added that Austen`s younger brother posted on social media that Austen
was the one who went to the dean of students (before they knew details of what occurred). He recalled Austen made
multiple references to leaving the team and disliking the team through the week before he went to the dean of students.
He recalled Austen telling him that he (Austen) was going to transfer to Ohio State to play hockey. He said Austen told
him "I`ll bury you…" when he came back to play BG. Jaden told me it was obvious Austen was trying to "get back" at
the team because he was being held accountable for stealing from the team.

Jaden also recalled going on a walk with several of his teammates around the football field, where they came across a
youth hockey team from Pennsylvania (near Austen`s hometown), and players from that team asked, "How`s Swankler
in the locker room?" suggesting that Austen is known for being a "cancer in the locker room."

On 9/22/23 at approximately 4PM, Det Shimel and I spoke with Cole Moore, who is a member of the BGSU Hockey
Team. I asked Cole to tell me his perspective of how this report came about. He said a player was going to be punished
for his conduct and as a result told the dean about rookie events. I asked him to tell me about "rookie day." He said "at
the end of the day, it`s team bonding" and a way for them to have fun together away from the rink. He added that
freshmen are involved, but upperclassmen are involved as well. He said as a freshman class, they planned to dress up
differently during the week leading up to rookie day to go to class and the rink in different outfits, such as beach and
cowboy attire.

On rookie day, he said the freshman met at his house on Second Street and they walked over to the hockey houses on
Fourth Street. When they arrived, they first went to a football player`s garage, then back to Fourth Street where they
played games. He said when they first arrived to Fourth Street, they got into cars and drove to a football player`s house
and went into the garage. He said they got t-shirts they made the night before with team names (the freshmen divided
into two teams for the events of the day) and a nickname (his referenced his height, though he did not recall the name).
I asked if they were blindfolded when they were driven to the garage. He said some guys were and noted the blindfold
was voluntary. He noted he could see through his blindfold. I asked if he was tied-up, which he denied having been.

I asked what happened in the garage. He said they got their shirts, had a drink, and returned to Fourth Street. He said
after that they went back to Fourth Street. I asked if they were blindfolded when they returned to Fourth Street. He was
blindfolded, but noted some of the guys took theirs off. I asked if the ones who removed their blindfolds were
chastised, though Cole said they were not. He said when they returned to Fourth Street the older guys told them to
enjoy the day and have fun. I asked Cole if he did the wall sit, which he did. He recalled two or three freshmen chose
not to partake. I asked if they got any grief for not drinking, to which he said they did not. He said they also played a
slip n` slide trivia game about the school or hockey program, as well as another game that involved bouncing a quarter
into a bucket. After that, Cole said he laid down for a few hours at one of the houses on Fourth Street. He explained
everyone was "taking a break" from the games and hanging out and no one gave them any grief for taking a break. I
asked him about the cucumber/ lipstick part of the day. He said a few of the seniors were in a room and freshman were
called in one-by-one and asked how their day was and if they were having fun or needed anything. They then told them
to pick "cucumber or lipstick." He saw lipstick in the room. Cole believed he picked the lipstick, after which they told
him to leave the room. He said it was "just to mess with guys" and it was "just a joke."

I asked if he felt pressured to drink at any point, to which he promptly said, "no." I asked if he felt that there

would be any negative push-back if he did not drink, which he also did not feel was the case. Cole explained that from
the onset, "they made it clear that you don`t have to participate." He added that there is one teammate who had a kidney
issue and cannot drink, and another who cannot drink due to medication, who did not drink and was not pressured to do
so.

I asked him why he believed this report was made. He said Austen was caught stealing from the team and as a result,
was going to be suspended. He felt Austen went to the dean because he did not want to take accountability for taking
the shoes. He also felt "this has been a long time coming" and said Austen has had an "attitude problem" for some time
and described him as "a cancer in the locker room."

On 9/25/23 at approximately 11:30AM I spoke with Nick O`Hanisain at BGPD. I asked Nick what his experience has
been thus far on the team. Nick admitted he was nervous about what college and the team would be like, but said he has
"loved it." He said his teammates have been welcoming since "day one." He said in regards to hazing, he has not
experienced anything of the sort. He noted he takes pain medication and as a result, he does not drink much, which his
teammates respected. He noted when he does drink, his teammates "have (his) back" and encourage him to be careful.
He felt closer to this team as a new teammate than any other team he has played on.

I asked him about rookie week or rookie day. He said he heard about it occurring at other schools and has talked with
friends about rookie week and was nervous about what would occur. He said the upper classmen explained beforehand
what was going to happen and told them it was "completely optional." He said they got outfits to wear during the week
and dressed one day as a cowboy. He recalled feeling "comfortable" with the atmosphere during the day and that one
teammate didn`t drink and he didn`t feel pressured to drink.

Nick said they were at the hockey houses (on Fourth Street) during most of the day playing drinking games. He
described the day as being for freshmen, though upperclassmen were playing games as well. I asked if he did the wall
sit. He said he did not, and added that Ethan Scardina told him not to. He was not present when the others did the wall
sit, but recalled the upperclassmen saying they did not have to do it, though the freshmen wanted to and did the wall sit/
drinking game anyways. Nick said he was hanging out with a few other players who didn`t drink.

I asked about being blindfolded. Nick said the team did team building earlier in the year and emphasized "sticking
together," so they chose to walk over together. Nick said they met at his house on Second Street and walked to the
Fourth Street houses. They were blindfolded and got into cars and driven to another house. He said he removed his
blindfold several times and didn`t feel pressured to keep it on. I asked if anyone gave him any grief for taking it off,
which they did not. I asked if his hands were tied, to which he replied they were not. He also said the blindfold was a
hockey sock so he could see through it, even when it was on. Nick said some guys were told to put the blindfolds back
on, but explained it was done in a joking manner.

Nick said they got to the garage and the whole team was there. He recalled it was loud and some people were

tapping hockey sticks on the ground as the "start" of the day. He recalled a lot of cheering as well. He said they were
all laughing, which was the tone for the day. He said they picked out nicknames and each got a shirt with the nickname
on it. He explained the nicknames were predetermined. They were then "iced" and he drank his Smirnoff. I asked
what else occurred in the garage. He said they were presented "vitamin C" which was "posed as cocaine." He recalled
the box of vitamin C being behind the powder. He described the container as something that could be bought as a
supplement at a grocery store. He was also confident that they would not encourage them to ingest cocaine. I asked if
anything else occurred in the garage. Nick said "there was a taser" but that no one was tased. He said there was
someone standing in the corner turning it off an on. He said he did not see it, but did hear it. He said they went back to
the Fourth Street houses after that.

When they returned to the houses on Fourth Street, where they played the drinking games he previously described. I
asked if anyone else was present, though he said only hockey players were there. I asked him about the cucumber/
lipstick portion of the day. He said that occurred later in the day. He said they knew about it beforehand as he was
tasked with buying two cucumbers. He also knew it was going to be a joke because someone was eating a cucumber
during the day. He later told me Scardina was the one eating the cucumber. Later in the interview, Nick said "we
obviously knew they were going to ask us, and he`s eating the cucumber, and, we were like, this is not a very fun
prank." I asked if anyone thought they were going to have to insert a cucumber in their anus, to which he said he did
not. He explained when the freshman talked about it before the day, they dismissed it as a joke.

I asked him to explain what occurred. He said it "was a gag kinda thing" where they were expected to "put it in your
butt" or they could put on lipstick and kiss someone`s "bad part." I attempted to clarify if he was referring to male
genitalia, and he replied, "anywhere around there." He noted he was unsure of the exact intent as he did not pick the
lipstick option. He said they were called into a room individually and asked to pick the cucumber or lipstick. He
recalled picking the cucumber and as they were giggling and told him to leave the room. He said there were on-going
jokes about it through the week before. He said the first day of the week, they had a list of things that were going to
occur. The list also encouraged them to stick together and one part said "everything is completely optional, and that
was underlined." I asked if that list still existed, which he seemed unsure. He noted it was given to one of the freshmen
and there may have been a picture taken of the list.

I asked him why he thinks this investigation is occurring. He said he has known Austen for seven years and "this has
always been a problem." He recalled talking with his friend and teammate, Dalton, talked about needing to "keep him
in check" and that they know how to "handle him," referring to his temperament. He recalled Austen telling him he
stole a pair of shorts, which Nick did not think much of initially. He later found out Austen took a pair of shoes, which
was not what Austen told him. He assumed Austen would receive a consequence for stealing, which he felt was
justified. He also told me Jaden told him of his conversation with Austen when Austen told Jaden he was going to get
back at the team for suspending him. Nick referred to Austen`s actions as "retaliation" for being suspended, which he
"saw coming." He saw Austen`s tweets about what occurred and said, "It`s very

frustrating because we got 27 guys who know the truth, and then, the tweets are not the truth."

After having spent time with the team, Nick said in regards to the vitamin C and the cucumber joke, he knew the seniors
would not do something that would harm them. He said, "it`s sad to see those guys being punished for something that
was basically a joke."

On 9/25/23 at approximately 1PM, spoke with Brandon Santa Juana at BGPD. Brandon is a freshman on the hockey
team. I asked him to tell me about his experience during rookie week. He said throughout the week, they came up with
costumes to wear to the rink. He said they had a meeting earlier in the week with the "older guys" where they told them
it was optional and that they didn`t have to do anything they didn`t want to. He said they met at Fourth Street at the
hockey houses. They also gave the freshman a rundown of the week.

I asked him to tell me about Saturday. He said the freshman met at the Second Street house and walked to the hockey
houses together. When they arrived, they got in the cars with blindfolds on, which they put on themselves. He said
they were taken to the "football garage" and they got out of the cars and went into the garage. He said they laid down
first and had shirts with Smirnoff Ice for the freshman. He said he did not drink his as he did not like the drink. He said
the shirts divided them into teams, which his was called, "Little Men." Brandon then referenced the "vitamin D stuff
that we had to snort, that happened." I asked him to explain how the vitamin D part occurred. He said the powder was
there with a pill bottle beside it, so he was confident it wasn`t a form of drugs. He said one of the seniors "did it first"
and they did it as well. I asked if anyone told him to do it, which he said did not occur. He said he did it to be funny.
He said the bottle was beside the powder. He described a pile of powder on a mirror with several smaller lines of the
powder.

Brandon said they then went back to the hockey houses and played drinking games. Before the games began, Brandon
said they were told they could "step out" and didn`t have to do anything they didn`t want to. I asked if he did wall sit.
He confirmed he did, but he was last in the line and there were only drops of the liquor left when the bottle got to him. I
asked if he knew what they drank. He was not sure, but described it as brown liquid in a "handle" (1.75-liter bottle),
though later believed it was a smaller bottle and did not have a handle on it. He also said it did not taste bad. They then
played a slip n` slide trivia game and another game that involved bouncing quarters into a bowl (both of which involved
them drinking beer). He said when the games were finished, it was "break time." I asked how much he drank that day.
He said he vomited, but believed he vomited from the volume of liquid in his stomach more than due to being
intoxicated. I asked him if anyone forced him to drink or pressured him to drink, which he said did not occur. He noted
several freshmen did not drink and they were not pressured to do so. He also said several freshmen opted out of
drinking during the quarter bouncing game and there was no issue with them doing so. I asked him if anything about
the day made him feel uncomfortable. He told me he felt reassured that they were allowed to "step out" at any point and
that they older players voiced that to them through the day.

Brandon also told me about the cucumber/ lipstick portion of the day. He said, "they made it seem like it was a lot more
than it actually was- that it was actually a joke… I wasn`t expecting to have to do any of that." I asked him to tell me
how it occurred. He said they went into a room and told him the pick the cucumber or lipstick and he chose the
cucumber. He said they laughed at him and told him to leave. He said during the week they were messaging the group
chat about the cucumber "jokingly." He said they referenced it "being put up your ass" but clarified that it was "jokes."
He said there was a cucumber and lipstick in the room. After that they learned the "win song and sweep song" (songs
they sing after winning a game or sweeping the weekend). He said they then had a "jersey party" that night.

I asked why he feels this report was made. He said, "I think from the outside view and screenshots and videos taken out
of context, it looks like it could be hazing. But without people seeing or like hearing our side of the story, I think it,
yeah, it`s def… you can look at it from both ways." I asked if he saw any screenshots, though he had not. I asked if
they seniors or anyone else gave them a list of what was going to occur that week. He said there was. He said the list
said "it was optional" and had instructions of what they were to do, and listed the outfits they were going to wear. I
asked him what the screenshots would look like. He suspected they would look like "drunk things."

I spoke with Brody Waters on 9/25/23 at BGPD around 3PM. I asked Brody what his understanding of the incident is.
Brody said he does not feel the events that occurred were hazing as they "all had the option to do it" and noted some
people sat out the team events. I asked him to tell me about rookie week. He said the Sunday before the week, they met
with the seniors to pick different outfits to wear to class that week. He noted the outfits were optional as well. I asked
him about rookie day. He said they (freshmen) met at the house on Second Street and they walked to the hockey houses
on Fourth Street. He said they put on blindfolds and got into the car and drove to a house with a garage. When they got
inside, they were given the shirts they made the night before with the seniors (with nicknames on them). He said they
were also "iced" and noted two of the freshmen did not drink theirs. I asked if the ones who didn`t drink were chastised
for not drinking. He said they were not, and said me the seniors told them throughout the whole day "don`t do anything
you don`t want, this was just meant to be fun." Brody said he had "a great time" and believed everyone else present did
as well.

He said there was "fake coke" on the table in a pile with lines of the powder next to the pile. He said it was obvious it
was not cocaine as the vitamin bottle was behind to the powder. One of he seniors snorted some of the powder and the
freshmen did the same. He said he rubbed his nose on it and wasn`t sure if he actually inhaled any of the powder.
Brody said it was noteworthy that in the car, when he was blindfolded, that he removed his blindfold and did no one
said anything to him. I asked if he was tied-up. He said he had tape loosely around his wrists which fell off before they
arrived at the garage. They then went back to the houses on Fourth Street. He said when the arrived, they were told,
"… lets have fun, if you guys don`t want to do anything, like, don`t do it, we don`t care, this is meant for you guys to
have fun."

He said they then did the wall sit, which six of the freshmen participated in. He said they drank a bottle of liquor
together and noted the last guy in line did not get any of the drink because it was finished by the time the bottle reached
him (he said he finished the bottle). Brody said he was the fifth person in the line, and Brandon Santa Juana was the last
person in line. I asked what they were drinking. He said he was unsure but didn`t think it was liquor because it wasn`t
strong. He said they then played the slip n` slide trivia, which he referred to as the most fun game. He noted one of his
teammates didn`t drink so they just counted to ten so he could participate without drinking. I asked if he vomited that
day. He said he did, but believed it was due to the volume of beer he consumed, not due to being intoxicated. He said
he "pulled trig" which he described as making himself vomit so he could continue to drink. He explained he was "pretty
bloated" and wanted to continue to drink. He said after that game, the upperclassmen said it was "nap time" because
"they didn`t want to overdo it with anyone or be "drinking all day." He said he went to bed and that everyone had a
teammate "watching over you" to make sure they were okay. He described it as "look out for your teammate thing." He
said he laid down, but decided to make a pizza with several of his teammates because he felt fine. I asked if anyone was
telling the freshmen to drink, which he said was not the case. He said they made it a point before every game to tell
them they did not have to drink.

Brody said after that, there was "this funny thing" where each of them got called into a room and they are given three
choices- one was lipstick, the other was cucumber "that was joked about," but he did not recall the third choice. He
recalled they were laughing when they gave him the options. I asked what happened when he picked the cucumber and
he said, "nothing." He said they joked about the cucumber beforehand and "it was clear" that it was a joke and he did
not believe he would have to "get a cucumber up my butt." He said he never "felt scared or threatened of anything." He
said after that he went downstairs. He said, "I had a great time, didn`t think this would ever come from it."

He said "one disgruntled player, just trying to, like, get back at the team because he got suspended for one game for
stealing from the team, that`s pretty much the story." I asked if he was touched with the taser. He said he did not, and
recalled there being a taser but said "they weren`t doing anything to make us scared or anything, it was all just for fun
and games and I was laughing the whole time." He was confident his classmates would agree. I asked if he was
worried about any of his teammates, which he was not.

Brody recalled walking into the rink two days before the incident became public and recalled Austen walking by him
saying "fuck this place I`m done." When he asked him what was going on, Austen told Brody he was suspended for one
game. He added that Austen was not a good teammate before this occurred, and referred to him as "always picking a
fight with someone." He said there have been multiple occasions where he was "going at it" with other players.

I then interviewed Ben Doran at BGPD on 9/25/23 at approximately 4PM. Ben confirmed that he is a freshman. I
asked him to tell me about rookie week. He said the Sunday before the week they had a meeting in which they told
them it was rookie week and planned to dress-up for classes, then an event on Saturday that involved drinking

games. He said freshmen and seniors were at this meeting. I asked him to tell me about rookie day. He said they met
at the house on Second Street, then they all walked over to the hockey houses on Fourth Street. He said they were
blindfolded with a hockey sock, then got into the cars and drove to another location where they went into a garage.

He noted the blindfolding was "optional" and told me at least one of the guys took the blindfold off. He said when they
went in the garage, they laid on the ground, seniors "welcomed them." He said they put shirts on that had
pre-determined nicknames on them, which they decided on the night before. He said they then got up and saw "vitamin
C" on a mirror. He noted one of the seniors "did it" and again told them it was "optional` and everyone laughed. Ben
said some guys opted to put their nose in the powder, which he did, but he was unsure whether he actually inhaled any
of the powder. He said the container was next to the powder on the mirror. He did not believe at any point it was
cocaine. He said several times that the seniors told them several times through the event that everything was optional.

He said they put the blindfolds back on and went back to Fourth Street. He said there was tape loosely around his
wrists, though believed it fell off on the way. He clarified that there was no tape on their wrists on the way back to
Fourth Street, and they put the loose tape on their wrists when they first left the houses on Fourth Street. I asked if he
did the wall sit when they returned. He said he did, and was the second person in line. He did not recall what they
drank and said it was "good" and did not believe it was hard liquor. He said two guys didn`t participate and the guy at
the end of the line didn`t get any of the liquor. He said the guys who didn`t participate were not chastised as a result.
He recalled "Scar" telling one of them not to drink (Ethan Scardina). He said, "they let us know, every single thing we
did, the whole time, was optional."

He described the seniors as the "nicest guys I`ve ever met." He explained that when he played for other programs, the
older players take the "rookie thing" very seriously and said coming to this program made him feel welcomed and said,
"I`ve never fit in with a group of guys as well as I have here." He said they played the slip n` slide trivia game and a
game that involved bouncing quarters into a bowl. He noted some older teammates played as well. He said after that he
went inside and was talking to some sophomores. He also recalled they were called upstairs where the seniors were in a
room and they were given three choices. He recalled only the cucumber and the lipstick and did not recall the third
option. He said when he went into the room, they told him to pick one. He picked the cucumber, at which time they
laughed and told him to leave the room. I asked Ben what he`d think if I told him someone had to insert a cucumber in
their anus. He immediately responded, "no way," at which time I conceded no one had to do so. He said they had a
theme party later that night.

I asked him if anyone did not have fun. He said he did not think so and noted everyone he talked to (freshmen) "loved
it." He said, "that was one of the most fun weeks of my life." He said, "it made it better because they weren`t really
giving us shit about anything, it was just like, if you don`t want to do it, don`t do it." I asked if anyone was nervous
going into rookie day. He did not believe so, and noted he was not. He said no one appeared

nervous.

I asked why he thinks this report was made. He said Austen was "bad teammate" and noted he was picking fights with
guys the first week of practice. He told me Austen stole a pair of shoes and as a result was being suspended for a game.
He recalled walking into the rink with Brody Waters and Austen told them "I`m fucking done" and said he was going to
quit. He said Austen started saving pictures from the group chat from a year ago and called someone from the team and
told him he was going to the dean of students. Ben suspected Austen was "trying to bring our program down." He also
said, "it just sucks because these guys are the nicest human beings ever… they made it optional for everything..." He
said, "I would do what we did a million times over again… these guys don`t deserve it whatsoever."

I interviewed Breck McKinley on 9/26/23 around 2PM. I asked him to tell me about rookie week. He first described it
as "super fun for me" and an experience with his classmates that he`ll never forget. He said during the week they wore
different outfits. He said on rookie day they met at a house on Second Street and went to the hockey houses on Fourth
Street. He said, "everything was voluntary that day, and they let us know early that they were not going to be forced to
do anything that day." He clarified they told them that before the day started and multiple times during the day. He
said they were given the option to put on blindfolds, which he did, and said they blindfolds were hockey socks. They
were driven to a garage where there were shirts for them, which had nicknames on them that they "came up with" the
night before. He said his nickname was a former player`s name plus 2.0 as they were from the same hometown.

He said they "got iced" and "there was the table with vitamin C powder on it and it was pretty clear to us it wasn`t
drugs…" He said a senior "did it" and they did it after him and noted they were laughing while doing it. He said he
was told by one of the guys that it was vitamin C powder. He did not see a container near the powder. Breck said they
put the blindfolds back on and were driven back to Fourth Street and they started playing drinking games. He said they
did a wall sit first, and noted two freshmen didn`t participate. He described "it wasn`t any, like, crazy hard liquor" and
noted they drank it before the bottle reached the last person. He said it was a normal sized liquor bottle and did not
have a handle on it. He said they then played slip n` slide trivia. After that played a game that involved bouncing
quarters into a bowl. He said several sophomores joined in that game as well. He said they played another game after
that, then everyone "took a break."

He said later in the day, the seniors were in a room and they went into the room one at a time and told to choose lipstick
or a cucumber. He said he chose the lipstick and they told him to "get out of there" as they were laughing. I asked what
happened if they chose the cucumber. He said "the joke was that they would like have to… stick it up your butt." I
asked what if he chose the lipstick. He said you`re supposed to like, kiss one of their balls or something like that… but
I obviously never thought they would do that to us," and they told him to leave and send the next guy in. He said they
then learned the "win song" and "sweep song." They had a party later that night. I asked if he knew what they were
drinking. He said it was brown and suspected it may have been rum. I asked if

he vomited that day. He said he did and suspected it was the result of the volume of liquid he consumed than as a result
of being intoxicated. He said the freshmen who didn`t drink were not chastised for not participating. He also recalled a
meeting with the seniors earlier in the week which he described as a dinner to talk about the school and program as well
as rookie week. I asked if anyone was telling them to drink during the event. He did not recall anything of the sort.

I asked how he felt about the week and rookie day. He described it as "awesome" and felt it brought the team closer
together. I asked if he got hit with the taser at the garage. He did not recall seeing or hearing one.

I asked why he thought this report was made. He said because a teammate had repercussions for something he did and
did not want to accept the consequences. He said, "so he decided to turn it against us and ruin other people`s lives…" I
asked how he got along with Austen before this. He described Austen as having a "short temper on the ice" and that he
does not have a good reputation in the "hockey world" and he was familiar with Austen before coming to BGSU. He
said Austen played in a Canadian league before coming to BGSU and Breck heard his former teammates signed a
petition for him to be removed from the team. He expressed frustration as Austen appears to be a "hero" in the "public
eye." I asked how he feels about this report, to which he replied, "it`s a lot of bullshit." I asked how much he and his
teammates have talked since the news broke. He said they have talked about it quite a bit. I asked if they talked about
what to tell investigators, to which he replied, "we all feel the same way, so we don`t need to do that."

On September 29, Austen Swankler sent me a text message, asking "Is there anything I can do about the player pointing
a pellet gun at me." I reminded him that when he told me about it during out first conversation, he said he did not feel
threatened. He replied, "I would say I felt threatened but didn`t see it going any further." I advised him I would discuss
the issue with the prosecutor, though based on his initial comment, I doubted there would be any legal action resulting.
I conferred with Pamela Gross (Wood County Prosecutor`s Office) who agreed there was no legal recourse for this
incident.

I sent emails and left messages for freshman Michael Bevilacqua to contact me to discuss the allegations, though never
received any follow-up correspondence from him. I also emailed Gustav Stjernberg to discuss the incident, though
again did not receive any reply from him.

Upon receiving the summaries of interviews with the BGSU hockey players and staff (conducted by Barnes &
Thornburg), I forwarded these to the city and county prosecutors. After discussing the interview summaries, as well as
the interviews I conducted, it was determined that no hazing charges were warranted for players or staff.
