Using European Standards to underpin the AI Act by providing a presumption of conformity . In CEN/CENELEC JTC 21 we are building up from the product safety approach to add the capability to address the protection of Fundamental rights too. From the consumer point of view, the reason this is possible is the ability of JTC 21 to map to the AI Act and to blend the AI technology standards from ISO with the consumer product and service standards from other parts of ISO that I have alluded to in previous posts. This blending means that AI technology companies putting products and services on the market don’t have to re-invent the wheel to be ‘on the market’ and can make use of the known good practice for consumer markets. Then for those experienced consumer product and service suppliers, familiar with ‘on the market’ good practice, they get the known technology good practice without having to experiment and develop that for themselves. There are a good number of product and service ‘on the market’ standards that ANEC as the consumer stakeholder representative organisation have flagged to JTC 21 that we are working on. To give a flavour of the contributions these standards make here’s a very high level view of 4 of them :- ISO 10377 which provides safety by design guidance for consumer products. This standard contains the good practice for understanding and applying ‘reasonably foreseeable use’ which is a vital part of the AI Act. The relevant clauses in 10377 need a bit of adaption to incorporate the software and AI perspective. ISO/IEC TR 6114 which provides guidance for security throughout the product (on the market ) lifecycle , essential reading. ISO 22485 which deals with the good practice for inclusive service and handling consumers who are vulnerable. Inclusive, non biased service being another key part of the AI Act. ISO 14452 a billing standard. This is less obvious in the AI Act but is nonetheless a technical issue for AI. If your AI functionality influences or directly feeds customer billing and charges then you have to deal with bill accuracy, fairness of charges ie lack of bias and not exploiting those with vulnerabilities. It is worth noting that when it comes to handling billing and other types of complaint ISO 10002 adds in that good practice as well.
