Patrick Rogel (talk) 22:35, 12 April 2019 (UTC)[reply]

Where is the line between art that is educational and art that is not? How could I recognize that? There are thousands of photos in Wikimedia Commons of art that are not used elsewhere. Are they all not educational? I enjoy browsing through pictures of art in Wikimedia Commons, used elsewhere or not. And there are even far more pictures of other subjects I would rather delete than these ones, for instance photos that look nearly simular, but aren't, or bad photos (not sharp); deletion requests for those were turned down. So why should these photos be deleted? And if lack of categories is an issueː I would love to categorize pictures of art, but I won't spend time to files which have been (or might be) nominated for deletion. So if categories would save these files for Wikimedia Common (or other art files), just ask me. JopkeB (talk) 08:46, 13 April 2019 (UTC)[reply]

First, the license on the facebook page isn't explicit enough, it just says "free to use", which could mean any of a number of things. But second, I don't think the picture is in scope. It seems to be a Swedish deejay that doesn't have particular notability; it is the only upload of User:Delayers112, and was apparently used for his only contribution to EN, which was speedily deleted back in 2012 (see [https://en.wikipedia.org/wiki/User_talk:Delayers112). This is a crop of a screenshot from a Moldovan news program https://www.youtube.com/watch?v=P0cRxcdqHaE around 0:30 or so. Now the program has been released by the news program, so normally screenshots from it would be fine, but this particular image is a still photo, and can't be guaranteed to be owned by the news program. It is not unheard of for news programs to use commercial or fair use photos like this that they didn't take themselves in their programs. GRuban (talk) 13:20, 31 July 2015 (UTC)[reply]

Normally that would be fine, but this was displayed as a still photo, so it's not guaranteed that Accent TV had the rights to release the photo. Unclear copyright status and unlikely to be own work: small/inconsistent resolutions, missing/inconsistent EXIF, per COM:PRP, considering User talk:Arm 01/logs with multiple similar uploads (all deleted by several reasons) and File:EVO Estadio Vasconselos OAXACA Broissin Architects Exterior.jpg (uploaded 2011) which was (even as part of a collage) previously published at official blog of "BROISSIN Architects" via http://broissinarchitects.blogspot.de/2008/10/oaxaca-warriors-baseball-park.html (2008). Per this user talk the user appears to be a student and not an employee of above company, so a permission from "BROISSIN Architects" would be appropriate.

This file was initially tagged by Ellin Beltz as Copyvio (copyvio) and the most recent rationale was: No official site or source of this image was found, see google search results. File uploaded in 2007, the file would have a source in that time. Amitie 10g (talk) 02:28, 31 July 2015 (UTC)[reply]

This was cropped from an Accent TV newscast, https://www.youtube.com/watch?v=cIP8YaxP9N4 at 1:22 or so ... however if you look around there, you will see it was a still photo, not part of the filmed newscast, so it's not guaranteed that Accent TV actually took the photo, so have the right to release it. Newscasts have been known to display photos that they didn't photograph. GRuban (talk) 03:55, 31 July 2015 (UTC)[reply]

Not clear that the photo was actually released into the public domain - "permission" link just goes to the Facebook page that (unless I just can't see it somewhere?) doesn't seem to say anything of the sort. It says shared with public, but that's not the same as released for the public to edit and reuse. GRuban (talk) 03:59, 31 July 2015 (UTC)[reply]

If User:Springjay is claiming to be Jo Ho, they really should write Commons:OTRS from an email address known to belong to her and say so. Otherwise the claim that they own Jo Ho's image from her web site and can release it under GFDL/CC_BY_SA seems far fetched. GRuban (talk) 04:04, 31 July 2015 (UTC)[reply]

I thought these images were posted on Flickr by an account owned by Shepard Fairey, but it does not seem to be the case (there is even a spelling mistake in the artist's name). So these are non authorized derivative works of a poster by a living artist, Shepard Fairey.

I realise that en WP has no bearing here. Even so please see en:Wikipedia:Sockpuppet investigations/S.P.Numbers where this editor has been determined to be the same editor as the subject of this picture, though not determined to be the same human being; ie. not necessarily Steve Humble.

Nonetheless this causes me to doubt the copyright ownership of the picture, since, if this is Steve Humble, the owner of the copyright will have taken the picture. I doubt that this is a self image.

I think that unwinding this requires a simple OTRS submission to show that the uploader owns the copyright Timtrent (talk) 14:26, 31 July 2015 (UTC)[reply]

In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in Belarus.. The building was designed by Valeriy Kucko (Russian: Валерий Борисович Куцко; born in 1955), Vladimir Budaev (Владимир Афанасьевич Будаев), Anatoliy Shabalin (Анатолий Андреевич Шабалин; born in 1946), Alexander Nitievsky (Александр Николаевич Нитиевский; born in 1961). This file was initially tagged by あそぼよワサワサッ! as Copyvio (Copyvio) and the most recent rationale was:

This file is the copyright violation:

  1. It comes from: 1974 Takeo Miki 3 - Tokyo Foreign Minister Press Photo. This website says "Copyright © 1995-2015 eBay Inc. All Rights Reserved.".
  2. This photograph was taken in Tokyo, Japan. This photograph was taken when Mr. Takeo Miki was serving as the Minister for Foreign Affairs. Mr. Takeo Miki served as the Minister for Foreign Affairs from December 3, 1966 to October 28, 1968. Therefore this photograph was taken after 1956. Then this problem is judged based on a Copyright law of Japan.
  3. Uploader said "This work is in the public domain in that it was published in the United States between 1923 and 1977 and without a copyright notice." However, the proof which supports his testimony does not exist.
  4. cf. Commons:Deletion requests/File:Kiichi Miyazawa-1.jpg.|source=http://www.ebay.com/itm/1974-Takeo-Miki-3-Tokyo-Foreign-Minister-Press-Photo-/200787102277?pt=Art_Photo_Images&hash=item2ebfd80a45

These appear to be bogus arms. No such person as "Hon Joshua Wood" (See Category:Wood family, past version: "Coat of arms of The Hon Joshua Edward Dylan Wood, BSc, and his descendants") is listed in Debrett's Peerage, 2015, either under "Earl of Halifax" (family name "Wood") or in the index. Created by User:Peeragegb, possibly a WP:Sock-puppet of User:Jwhalifax, on whose user page is stated: "The Hon Joshua Wood is graphic designer, heraldic artist and a filmmaker based in London, United Kingdom." This image appears to relate purely to WP:Self-promotion, for which activity WP and commons are not appropriate places.Lobsterthermidor (talk) 19:06, 31 July 2015 (UTC)[reply]

  • The Hon Joshua Wood[1] did not submit this file. I would suggest not to use words such as bogus. If I am not published in Debretts Peerage 2015 and my family did not submit relevant documentation and information to Debretts that does not mean that I do not exist. I do not need to self promote myself, I have a Facebook and other resources to do so... You should be paying more attention to those people who deliberately submit false information and false claims that they are sons of The Rt Hon Charles Wood, 3rd Earl of Halifax for example, in addition claiming to be Viscount of Halifax living at Hickleton Hall Estate. I think you should be focusing more on that instead of attacking me (the person who contributes useful images to Wikipedia through my profile). I would suggest you not to make any connections with my name to other profiles or contributors to Wikipedia. In regards to my identity and style, see https://commons.wikimedia.org/wiki/File:MG_1204.png file. --Jwhalifax (talk) 15:14, 1 August 2015 (UTC)[reply]
    • No such legal person as "The Hon Joshua Wood" exists, so he cannot have a valid coat of arms. Invalid/inaccurate/bogus coats of arms are of no use to wikipedia users, and only serve WP:Self-promotion or to deliberately mislead, which are not valid uses of WP or commons. "The Hon." is a courtesy title used by sons of peers, and according to Debrett's Peerage, 2015, p.550, the present Earl of Halifax has only one son, Lord Irwin, whose first names are "James Charles" and who so far has only one son named "Hon.Rex Patrick Wood", born in 2010. The index does not list "Hon Joshua Wood" under any other peerage in the United Kingdom.(Nor is it a proper use of commons to upload such an image as User:Jwhalifax has done, see File:MG_1204.png. This is not Facebook). Any fantasist can call himself or herself "The Hon." and request DVLA to amend the name accordingly on a driving licence. If on the other hand, as the link to the image of the envelope from Buckingham Palace seems to suggest, the Queen granted the right to "Joshua Wood" to use the courtesy title "The Hon.", which would surely break all precedent, that is another matter, and no doubt on that basis the College of Arms might have granted said "Hon Joshua Wood" his own coat of arms, perhaps even with the extra-special honour of a grant of supporters (as shown in File:Coat of Arms of The Hon Joshua Wood.png), almost invariably borne by peers alone. I repeat: possibly User:Peeragegb is a WP:Sock-puppet of User:Jwhalifax (known as "The Hon Joshua Wood"), used to impart credibility to the image and to suggest in a deliberately misleading fashion that it was sanctioned or contributed by an official organisation called "Peerage of Great Britain" or similar. I request the image be deleted as deliberately misleading and self-promotional unless proof of the validity of such arms is cited from a reputable heraldic source.(Lobsterthermidor (talk) 11:56, 2 August 2015 (UTC))[reply]
      • You must be out of your mind. I submitted a copy of UK government issued Identification document with my name on it, and you still insist on that, "No such legal person as "The Hon Joshua Wood"". I am not claiming to be the son of Earl of Halifax! The Earl has only one son, Lord Irwin indeed as we argued with few guys claiming to be his sons. My point here is that I am the Hon Joshua Wood which I cleared by providing UK government issued Identification document and that these coat of arms are mine, they are not Invalid/inaccurate/bogus. There is no such name as "The Hon" and therefore one can not request DVLA to amend the name on a driving license, do not mislead people with your sick imagination. People are restricted from changing their name to a courtesy titles, read the UK laws. One can in fact have a name or change it to Lord, Duke, Earl, Baron not "The Hon", "The Rt Hon" etc. Sir, you literally twisted everything. The envelope is a proof of the form of address, it is also stamped by the Royal Mail as delivered. "The Hon." is a courtesy title granted to children, grandchildren of peers at the age of approximately 4. In 2015, the registration of coat of arms is not a must, anyone can have coat of arms either designed by the College of Arms or by private graphic designer, it can be kept as private or public, even as a logo to represent the person that it is designed for...etc
      • If you want these arms to be removed, nothing will ever change your mind and nothing will stop you from doing it. Arms mostly adopted from my ancestors, with changing design according to College of Arms rules when one is not an heir to peerage, but has ties to the family is in full right to have the elements representing his ancestral background, in fact, one can use all ancestral shields of all his/hers lineage in one. --Jwhalifax (talk) 14:09, 2 August 2015 (UTC)[reply]
        •  Löschen - After checking the uploads of User:Peeragegb and Jwhalifax it is obvious that Peeragegb is a sockpuppet of Jwhalifax. Both nicks use the identical illusive, not existing categories, both overcat in the same manor and flood meta categories with nonsense entries.
        • Even the nick indicates that he pretends to be related to the Earl of Halifax. The entire project looks like a self promotion and desired proof of a noble status that does not exist. -- Maxxl² - talk 15:00, 2 August 2015 (UTC)[reply]
          • I think Maxxl2 you've said all that needs to be said. But as I had just finished drafting my own reply before you posted, and at the possible risk of over-kill, I'll add that too: "The Hon." is not "a courtesy title granted to children, grandchildren of peers at the age of approximately 4", but is accorded at birth to sons alone of peers. As you say above, no one forces anyone to register DIY coats of arms, but those not granted by and registered at the College of Arms in London are generally termed "bogus". These may properly be called "trademarks", "logos", etc, but not "coats of arms". You still have not provided proof of the validity of such arms by citing a reputable heraldic source. Wikipedia and commons are not suitable places for publishing coats of arms "designed by a private graphic designer" reputedly for non-notable persons who have no other claim to legal existence other than a name on an envelope from Buckingham Palace (no doubt replying to their own letter so signed and headed) and a driving licence. The last item is not evidence of a person's valid right to use the courtesy title "The Hon.", as on application by anyone at all DVLA will add almost any title (Dr., The Hon., Lord (life peer)) to a driver's name without any evidence being demanded whatsoever except in the case of hereditary titles (i.e., Duke, Marquis, Earl, Baron). You are possibly familiar with this provision, set out in the DVLA's website https://www.gov.uk/change-name-driving-licence "Change the name on your driving licence". The image is "bogus" (to use the term usually adopted in such cases), possibly deliberately intended to mislead, possibly self-promotional, and possibly uploaded by a sock-puppet.(Lobsterthermidor (talk) 16:00, 2 August 2015 (UTC))[reply]

That was my reason to believe the copyright claim. Due to this, I somehow suspect this photo may well belong to a person named Kevin Schmitz. This file was initially tagged by Magog the Ogre as no source (No source since)... but I found this image at http://www.dnainfo.com/new-york/20100115/manhattan/fbi-hopes-times-square-billboard-will-help-catch-fugitives dated to 2010 (and http://www.vosizneias.com/47071/2010/01/15/manhattan-ny-times-square-billboard-to-display-fbi-most-wanted/) and identified to FBI. The image there is the same 28Kb size as this one. Would the consensus thus be to keep it as an FBI work? However, on page http://atlantic.tv-sign.ru/en/2010/8.html, the photo credit is to SanLuisObisbo.com. I was unable to find that photo on that website. I did however find a bigger version of this image at (http://file2.answcdn.com/answ-cld/image/upload/w_760,c_fill,g_faces:center,q_60/v1401340263/dzirbfmmibtyafwwmqey.jpg) and would suggest that if this is kept, the larger version be uploaded instead.
