COM:TOYS. There may be more.

Delete This upload is a mistake of mine. There is no reason to exist. It's OK to delete it. Thanks and sorry.--Stepanps (talk) 14:30, 25 April 2018 (UTC)[reply]

  • @Yann: I was specifically referring to the last photo, File:THW Jugend Playmobil.jpg. Please note that according to German FOP laws, even artworks that e.g. are moved during the night are considering to fall under FOP provisions. I.e. it's not important that they are immobile, it's just important that the exhibition is permanent (even if it is not exhibited all the time).  Delete I thought Playmobil was very old, but it was only invented in 1974: Playmobil. - Alexis Jazz 13:38, 23 April 2018 (UTC)[reply]

Playmobil was invented in 1974. COM:TOY

@Yann: File:SpeyerPlaymobil.JPG doesn't seem that permanent. It's about as permanent as a movie poster. Would a photo of a movie poster be considered FoP in Germany? - Okay, the date actually indicates it would have been in place for about half a year. That's longer than a movie poster, not sure if it qualifies as "permanent" though considering it has a set end date. - Alexis Jazz 15:11, 23 April 2018 (UTC)[reply]
Comment {{FoP-Germany}} does not allow temporary displays in public space. — Racconish 16:57, 23 April 2018 (UTC)[reply]
I think we have had this discussion already about election posters. See also Srittau's comment above. Special cases like this one should be nominated separately. Regards, Yann (talk) 04:40, 24 April 2018 (UTC)[reply]
I think Srittau's comment refers to non-stationary art, as in the AIDA kissing lips German jurisprudence, which is not the case here. I would argue the Liebe deine Stadt jurisprudence is more pertinent, with its reference to the criterium of persistence (bleibend), where the Court specifically ruled the artwork was displayed for "a period of time longer than a temporary art exhibition". In any case, I agree with you : such a specific case should be discussed separately. — Racconish 08:48, 24 April 2018 (UTC)[reply]

Comment I don't have an opinion on the copyright for toys. However I'd like to highlight that my Playmobil pictures were uploaded 8 years ago and have been used in 6 Wikipedias since then. Other files proposed for deletion here were uploaded 13 or even 15 years ago and have been used on Wikipedia for over a decade. Commons rule on toys did not exist at the time these files were uploaded. This is an obviously demoralizing situation for Commons contributors, myself included. Moving forward, Commons rules should be made clear and applied swiftly and no file should be left lingering for 15 years before being deleted. D4m1en (talk) 18:06, 24 April 2018 (UTC)[reply]

@D4m1en: I agree with that. Unfortunately getting clear rules in place is something that is in practice reserved for a lucky few and there are not enough volunteers to apply them swiftly. Any suggestion to help this situation would be welcome at the Village Pump (or copyright Village Pump). - Alexis Jazz 19:34, 24 April 2018 (UTC)[reply]

CommentThe rational given for deletion of File:Sarajevo Dolac-Malta 2011-10-25 (14).jpg is COM:TOY. The picture doesn't show a toy. It shows an advertisement car. I don't think the picture should be deleted. --My-wiki-photos (talk) 01:07, 24 April 2018 (UTC)[reply]

You are right it is not a toy. Here is a new DR for it: Commons:Deletion requests/File:Sarajevo Dolac-Malta 2011-10-25 (14).jpg. - Alexis Jazz 18:31, 24 April 2018 (UTC)[reply]
