    The proposed replacement image depicts the subject almost two decades after his 1989 trial and 24 years after his arrest. The trial of this individual proved to be the most expensive trial in Orange County history at the time. This was the pinnacle in the subject's life as to his notability. Also, the use of a lower-quality portion of this image (which is freely available online and in printed format and uncropped) is not an infringement of any copyright clause. Was also published before March 1989. A concern of mine is that the proposed replacement image may steer new/casual readers into the belief of the subject's life after incarceration and some form of miscarriage of justice (which he has claimed following his 1983 arrest and vociferously since 1989). — Preceding unsigned comment added by Kieronoldham (talkcontribs) 04:30, September 7, 2021 (UTC)
    Our standard for fair-use images of people is very high when a free replacement exists, so I don't think that is sufficient. However, the PD angle is worth exploring. Can you provide evidence that it was published before March 1989? The image description says "taken in Aug. of 1989". -- King of ♥ 04:37, 7 September 2021 (UTC)[reply]
    I understand. My error when I wrote the image was taken in August of 1989 (that was when he was sentenced to death). The images were taken in early 1989 by one Leo Hetzel. The book Angel of Darkness (which I own a copy of) states this. Here is an April 25 1989 image of the front page of the L.A. Times displaying the image in question. Obv. this is the month after March though. I cannot find an online image verifying if it was taken before March 1. I just believe a more contemporary image would suit the article better. CA government images are in the public domain. Should be easy to find an image of his 1975 or 1983 arrest maybe. Regards, --Kieronoldham (talk) 22:35, 7 September 2021 (UTC)[reply]

Perfectly justifiable and acceptable use of the image under the clearly-stated non-free licence as Wikipedia policy: '10 Pictures of deceased persons, in articles about that person, provided that ever obtaining a free close substitute is not reasonably likely.' In many years of searching I have never been able to find a free image of Joseph Clayton Clark. In the public domain in the UK. Jack1956 (talk) 18:44, 7 September 2021 (UTC)[reply]
