    COMMISSION IMPLEMENTING DECISION (EU) 2023/2726

    of 6 December 2023

    amending Implementing Decision (EU) 2016/2323 establishing the European List of ship recycling facilities pursuant to Regulation (EU) No 1257/2013 of the European Parliament and of the Council on ship recycling

    THE EUROPEAN COMMISSION,

    Having regard to the Treaty on the Functioning of the European Union,

    Having regard to Regulation (EU) No 1257/2013 of the European Parliament and of the Council of 20 November 2013 on ship recycling and amending Regulation (EC) No 1013/2006 and Directive 2009/16/EC (1), and in particular Article 16 thereof,

    Whereas:

    (1)

    Article 6(2), point (a), of Regulation (EU) No 1257/2013 requires ship owners to ensure that ships destined to be recycled are only recycled at ship recycling facilities included in the European List of ship recycling facilities (‘European List’) published pursuant to Article 16(2) of that Regulation.

    (2)

    The European List is set out in Commission Implementing Decision (EU) 2016/2323 (2).

    (3)

    The authorisations of AF Offshore Decom, Green Yard AS and Aker Solutions AS (Stord), ship recycling facilities located in Norway, are due to expire on 28 January 2024. The authorisation of Fosen Gjenvinning AS and Norscrap West AS ship recycling facilities also located in Norway, are due to expire on 9 January 2024 and 1 March 2024, respectively. The Commission has received information from Norway that the authorisations to conduct ship recycling granted to those facilities have been renewed prior to their expiry, in accordance with Article 14 of Regulation (EU) No 1257/2013. Furthermore, Norway informed the Commission of changes concerning method of recycling and type and size of ships accepted by AF Offshore Decom, of changes concerning maximum annual ship recycling output reported by Green Yard AS and Aker Solutions AS (Stord) and of changes concerning type and size of ships, limitations, and conditions as well as maximum annual ship recycling output reported by Norscrap West AS. Also, Finland informed the Commission of a change to be made in the expiry date of the authorisation of Turun Korjaustelakka Oy (Turku Repair Yard Ltd), Latvia of a change concerning maximum annual ship recycling ouput reported by ‘Galaksis N’ Ltd and the Netherlands of changes in contact details for Damen Verolme Rotterdam B.V. and DECOM Amsterdam B.V. The European List should therefore be updated accordingly.

    The Commission has received information from Denmark that its competent authority has withdrawn the authorisation to conduct ship recycling granted to Stena Recycling A/S as the facility does not operate ship recycling activities. That facility should therefore be removed from the European List.

    (5)

    The Commission has received information from the Netherlands that Scheepssloperij Nederland B.V. is no longer in the ship recycling business. The competent authority has therefore withdrawn the facility’s authorisation to conduct ship recycling. That facility should therefore be removed from the European List.

    (6)

    The Commission has received information from Norway that Lutelandet Offshore AS is no longer in the ship recycling business. The competent authority has therefore withdrawn the facility’s authorisation to conduct ship recycling. That facility should therefore be removed from the European List.

    The inclusion in the European List of Leyal Gemi Söküm Sanayi ve Ticaret Ltd. and Leyal-Demtaş Gemi Söküm Sanayi ve Ticaret A.Ş., ship recycling facilities located in Türkiye, are due to expire on 9 December 2023. The Commission has received information from Leyal Gemi Söküm Sanayi ve Ticaret Ltd. and Leyal-Demtaş Gemi Söküm Sanayi ve Ticaret A.Ş. that they wish to renew their inclusion in the European List, in accordance with Article 15 of Regulation (EU) No 1257/2013. Having assessed the information and supporting evidence provided and gathered in accordance with Article 15 of Regulation (EU) No 1257/2013, the Commission considers that the facilities comply with the requirements set out in Article 13 of that Regulation to conduct ship recycling. The inclusion of those ship recycling facilities in the European List should therefore be renewed.

    The inclusion in the European List of International Shipbreaking Limited L.L.C, a ship recycling facility located in the United States of America, is due to expire on 9 December 2023. The Commission has received information from International Shipbreaking Limited L.L.C that it wishes to renew its inclusion in the European List, in accordance with Article 15 of Regulation (EU) No 1257/2013. The Commission has carried out an assessment of the information and supporting evidence provided and gathered in accordance with Article 15 of that Regulation. The Commission considers that the facility complies with the requirements set out in Article 13 of Regulation (EU) No 1257/2013 to conduct ship recycling. The inclusion of that ship recycling facility in the European List should therefore be renewed.

    Implementing Decision (EU) 2016/2323 should therefore be amended accordingly.

    The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 25 of Regulation (EU) No 1257/2013,

    HAS ADOPTED THIS DECISION:

    Article 1

    The Annex to Implementing Decision (EU) 2016/2323 is replaced by the text in the Annex to this Decision.

    Article 2

    This Decision shall enter into force on the third day following that of its publication in the Official Journal of the European Union.
