Looking back on the last month event at the Third Annual GC Summit, held by Legal500 at the Kempinski Hotel, Jakarta, our Managing Partner, Ellrico P. Situmorang, shared his expertise during a session focused on Managing International Disputes. Together with other featured speakers and moderated by Joseph Boswell, this session provided practical advice on negotiation tactics and communication strategies for handling complex cross-borders disputes, both in anticipation of and following their occurrence. During the session, Ellrico specifically addressed the role and function of external counsel in respective stages of dispute; starting from when the potential dispute arises until the dispute process. Sharing his valuable experience in handling disputes, Ellrico also emphasizes the necessity for general counsel to have a dispute-in-mind even from the contract drafting process. The other speakers also shared some hints for selecting the appropriate external counsel based on the specific needs of the company. This outstanding event was attended by over 150 general counsels and heads of legal from diverse industries across Indonesia. #PSHPUpdate We understand that effective business management often requires adept handling of debt restructuring, especially amidst operational hurdles or financial strain. Hence our recent internal training centered on the topic of "Debt Restructuring: PKPU vs. Consensual Restructuring", where we explored the landscape of methods of restructuring within the Indonesian legal framework. The aim was to furnish our lawyers with a grasp of the restructuring process, encompassing both court-supervised and non-court-supervised methods, covering every essential component involved in each method. Our associates, Aditya Wijaya and Eugenia Rachel Wiyarta, provided guidance on exploring the achievements relevant for each of the restructuring methods, outlining each procedure, as well as the necessary documentation structure for debt restructuring through both the PKPU and consensual restructuring methods. To enrich the session, active participation from the participants was required, with participants divided into two groups, allowing each individual to express their views on the flexibility and legal certainty offered by each method. We are delighted that the training shared valuable insights with our team and enhancing our awareness of topics pertinent to restructuring in Indonesia. #PSHPLaw #Restructuring

We are pleased to share the recent success of our Litigation & Alternative Dispute Resolution team in representing a multi-national steel manufacturer in a shareholder dispute involving its Indonesian Joint Venture Company. Led by Ellrico P. Situmorang with the full support of our Associates, Panji Satria Utama and Giantama Gariantka, the PSHP Law team managed to assist the client in defending its rights. Despite heavy pushback from the counterpart, PSHP Law successfully guided the parties to reach an amicable settlement and to encourage all high-profile shareholders of the JV Company to act in accordance with the previously-agreed Joint Venture Agreement. This success shows the firm’s dedication to delivering strategic and tailored solutions in resolving various types of litigation and/or commercial dispute matters. #PSHPUpdate   We are excited to share our latest in-house training session titled "From Policy to Practice: A Deep Dive into Carbon Trading Regulations and Market Mechanisms" presented and led by our associates, Mery Enjelica Stephany and Renanda Aditya.   Following the release of their first article in the Indonesian Net Zero series, they showcased their in-depth comprehension of the regulatory facets and market mechanism associated with carbon trading policies. This encompasses an exploration of Indonesia's regulatory framework and a detailed breakdown of the schemes for each emission trading and offset emission as well as the relevant agreements including Emission Reduction Purchase Agreements (ERPA).   The session captivated participants through an engaging quiz designed to build-up their understanding of this intricate topic. This interactive approach not only garnered interest but also ensured active participation from the audience. We are delighted to announce our role as Indonesian legal counsel for the USD 22 million Series A funding raised by SWAP Energy. This successful transaction, closed by the end of December 2023, featured key investments from three prominent entities namely Qiming Venture Partners, GGV Capital and Ondine Capital. Since its establishment in 2019, SWAP Energy has been actively engaged in providing an integrated electric vehicle ecosystem in Indonesia. This includes the provision of swappable battery packs, operating swapping stations and the distribution of electric motorcycles. The company currently operates a network of approximately 1.500 battery swapping stations that are strategically located across numerous cities in Jawa, Sumatera, Bali, Kalimatan and Sulawesi. In line with Indonesia’s ambitious goal to produce nine (9) million electric motorcycles by 2030, the funding received by SWAP Energy is anticipated to position the company as a significant contributor to this target. We strongly believe that SWAP Energy will play a substantial role in continuing to establish Indonesia as a key player in the electric vehicle landscape.
