Section 101(a)(5) of the Rehabilitation Act of 1973, as amended by title IV of WIOA, establishes provisions related to the Order of Selection (OOS) for VR services. The U.S. Department of Education implements these provisions in VR program regulations at 34 CFR § 361.36. VR agencies outline their ability to serve all eligible individuals with disabilities in the VR Services Portion (part "m") of the WIOA Unified and Combined State Plans. Priority must be given to serving individuals with the most significant disabilities if a VR agency is unable to serve all eligible individuals with disabilities.
Effective July 25, 2024, the following VR agencies are operating under an OOS, as approved in their Program Year 2024-2027 WIOA State Plan, and have one or more closed priority categories:
- Florida Division of Vocational Rehabilitation (FL-G): 1 of 3 priority categories open
- Indiana Bureau of Rehabilitation Services (IN-C): 2 of 3 priority categories open
- Iowa Vocational Rehabilitation Services (IA-G): 1 of 3 priority categories open
- Maryland Division of Rehabilitation Services (MD-C): 1 of 3 priority categories open
- Oklahoma Department of Rehabilitation Services (OK-C): 1 of 3 priority categories open
- Vermont HireAbility (VT-G): 3 of 4 priority categories open
- Wisconsin Division of Vocational Rehabilitation (WI-C): 2 of 3 priority categories open
