Campbell Barker of the Eastern District of Texas issued an “administrative stay” preventing United States Citizenship and Immigration Services (USCIS) from approving any further applications for “parole in place” under Keeping Families Together, which shields undocumented spouses and stepchildren of U.S. citizens from the threat of deportation. On August 23, sixteen state Attorneys General sued the Biden administration in the Eastern District of Texas, seeking a preliminary injunction to prevent the implementation of a program providing relief to undocumented spouses and stepchildren of U.S. Citizens that took effect on August 19, 2024. First announced by President Biden on June 18, 2024, the Keeping Families Together (Parole in Place for Noncitizen Spouses and Children) program is expected to shield as many as 500,000 undocumented spouses and 50,000 undocumented stepchildren of U.S. citizens from deportation and to give them an opportunity to apply for lawful permanent residence without leaving the United States. A federal judge in Texas just issued an order finding that the FTC’s Noncompete Rule constitutes an “unlawful agency action” because the FTC “lacks statutory authority to promulgate the Non-Compete Rule,” and because “the Rule is arbitrary and capricious.” As a result, the court permanently enjoined the Rule from taking effect on a nationwide basis.  While there will certainly be an appeal of the court’s order, it will not be resolved in the near future, and its outcome is far from certain. This week, Fred Shrayber co-authored a client alert, “The FTC Non-compete Rule Approaches: What To Do Now” The US Federal Trade Commission (FTC) issued a regulation earlier this year that effectively bans most non-competes for employees and independent contractors (the FTC Rule). The effective date of the FTC Rule is September 4, 2024. As expected, there has been litigation challenging the FTC Rule as exceeding the agency’s authority. However, with only a couple of weeks remaining before the effective date, the FTC Rule has not (yet) been struck down, and the outcome of the court challenges remains unclear.
