"China has acceded to the 1961 Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents, an international treaty that replaces the legalization procedure with a certification called an apostille. In other words, apostilled documents issued by one of the member countries of the Convention have the same effect in another member country regarding their authenticity. Accession took place on March 8, 2023, and took effect on November 7, 2023." This weekend, our Bay Area offices gathered for a Kilpatrick Community beach clean-up event at Linda Mar Beach in Pacifica. Volunteers collected over 70 pounds of trash, 7 pounds of recyclable material, and 840 cigarette butts. The town mayor stopped by to thank the Kilpatrick Community members before our volunteers enjoyed a lovely lunch at Round Table Pizza. Special thank you to everyone who participated and to Jim Karkas for organizing the event!

Bright Ideas, a publication of the Intellectual Property Law Section of the New York State Bar Association, recently published their latest issue with an article from Kilpatrick's Ted Davis. In this article, Ted, along with co-author Joseph Davis, addresses recent opinions bearing on the intersection of the free speech and trademark rights. Part II examines the content discrimination vs. viewpoint discrimination framework introduced into the registration context by the Supreme Court’s opinions in Matal v. Tam and Iancu v. Brunetti, but dispensed with by the Court in Vidal v. Elster. Along with Part II, Part III examines the Court’s 2023 decision in Jack Daniel’s Properties, Inc. v. VIP Products LLC and applications of it by the lower federal courts since its issuance.
