2. PURPOSE:

To prescribe the set of guidelines and procedures on the detail of lT personnel


such as Police Commissioned fficer, Police Non-commissioned Officer and Non-
Uniformed Personnel to other PNP Offices/Units.

3. SCOPE:

Uniformed and Non-Uniformed Personnel of lnformation Technology


Alle
Management Service (ITMS) detailed and will be detailed to other PNP Offices/Units in
support to lT-related projects and activities.

4. DEF]NITION OF TERMS:

a. Administrative Supervision- Supervision in the performance of duties and


responsibilities pertaining to ITMS detailed lT personnel.

b. Application System - a group of related software application programs


designed to perform a specific function.

c. Detail - temporary movement of lT personnel from the ITMS to other


PNPffices/Units.

d. lnlormation Technology (lT) Personnel- refers to the ITMS personnel


performing lT related tasks/functions.

e. lT Project - an activity/projecUendeavor that will be undertaken by lT


personnel through an application of lT with an expected specific results/output of
product and service within a predetermined time in a particular office/unit.

f. lT Resourcee- are the infurmation processes, hardware, softrare and


services, supplies, personnel, facility resources, maintenance, training, or other related
resources.

g. Letter Ordep - an administrative order issued authorizing the detail of ITMS


lT personnel to other PNP ffices/Units to undertake lT-related projects and activities.

h. Operations Superuision- Supervision of personnel in the performance of


functions required for the accomplishment of lT-related projects and activities of ITMS
detailed personnel.

i.Pereonnel Placement Board- referc to the group of offtcers duly authorized


to undertake the screening and evaluation of personnel due for detail to other
un its/offices.

j. Receiving Offfce - any PNP Ofiices/Units where the lT Perconnel will be


placed on detail.

k.
Request for !T Peponnel - a written request through a memorandum from a
PNP Office/Unit requesting the detail of lT personnel.

5. POLICY GUIDELINES:

a. General Guidelines:
1. lT personnel who have rendered at least six (6) months actual duty from
the date assigned at ITMS with at least very satisfactory (VS)
performance on the last rating period and with no pending case shall be
considered for detail.

2. All ITMS Personnel for detail shall be knowledgeable and/or have


undergone any of the following lT related trainings.

a) Office Productivity (lT Concepts, MS Word, Excel & PowerPoint)


b) Database Management
c) Multimedia Photo Editing
d) Computer maintenance & trouble-shooting
e) Computer Networks
f) Basic Web Development using Content Management System
(cMS)
g) System Analysis & Design (SAD)
h) lnformation System DevelopmenUProgramming
i) Computer Security
j) lT Technical Writing

3. The following ranks/salary grade shall be considered for detail:

a) Police lnspector to Police Superintendent for PCOs;


b) Police fficer 1 to Senior Police fficer 3for PNCOs; and
c) NUP-Salary Grade 18 and below.

4. The following are the number of lT personnel that will be allowed for
detail except in the exigency of the service.

Command Group D-Staff/P-Staff- maximum of 2


PROs - maximum of 3
NSUs - maximum of 2,

5. The function or duty to be performed by the detailed personnel shall be


in support to PNP lT projects or lT-related activities.

6. The duty of detailed lT Uniformed Personnel is based on the mission


that shall be accomplished for a minimum of six (6) months and may be
extended upon the request of the receiving office/unit, and shall not
exceed two (2) consecutive years except in the exigency of service or
upon completion of project/task. And for Non-uniformed personnel, a
maximum of one (1) year per CSC res. 2002-1181 sec. 2.

7. lT personnel shall be assigned to PHAS Administrative Office, ITMS


while on detail.

8. Detailed lT Personnel shall report directly to the CoS or RCDS of


concemed NSUs or PROs, while detailed lT Personnel shall report
directly to the Ex-Os of respective Directorates.

9. Requests for extension shall be signed by Director of requesting


uniUoffice and shall be addressedto Director, ITMS at least five (5)
days prior to the expiration of detail of lT personnel concerned.

Absence of such request within the allofted time directs the lT


personnel to report back to the ITMS as their detail order expires.

b. Administrative Supervision :

1. Punctuality, Attendance and Leaves:

a) The receiving office shall be responsible in monitoring the punctuality


and attendance of detailed lT personnel; and
b) Application for leave shall be processed by Administrative Office,
ITMS, upon recommendation of the receiving office for approval of
Director, ITMS, subject to existing PNP policies.

2. Performance Monitoring:

a) The performance of the detailed lT personnel in the IPER shall be


rated by the immediate supervisor and reviewed by the chief of
division of the receiving ofiice and to be further evaluated by the
Administrative Officer of ITMS in coordination with Plans Office;
b) The performance rating of the detailed lT personnel together with their
monthly accomplishment reports shall be considered as basis in their
recommendation for Awards, Special Recognition, Commendation,
and other benefits that may be provided by ITMS.
c) One satisfactory (S) rating shall be ground for the cancellation of detail
order.

3. All administrative matters shall be processed by ITMS such as:

a) Request for mandatory and specialized trainings;


b) Recommendation for promotions;
c) Request pertaining to personnel records such as: lDs, Service
Records, Leave Records, Certificate of Legal Beneficiaries, Order of
Entitlement, Change of Status;
d) Certifications such as Duty Status, Non-Pending Case, Non-Money
and Property Accountability;
e) Personal Claims such as PlBs, RCA, Salary Differentials;
f) Submission of PER, PFT and SALN;
g) Updating of Police Personnel File; and
h) Other similar matters.
4. Detailed lT personnel shall attend the following command activities:

a) New Year's Call to D, ITMS;


b) lT Family Conference;
d) NAPOLCOM Audit, lnspection and Monitoring; and
e) PNP ITMS Anniversary

Those that are detailed in PROs 2,4B.,5,6-18, COR, ARMM, CARAGA


may opt to attend above activities.

5. Authority of the ITMS to discipline detailed lT Personnel:

a) The authority to discipline detailed personnel remains with the


Disciplinary Authorities given jurisdiction to hear and decide under
NAPOLCOM MC Nr 2016-002, CSC Omnibus Rules and other related
issuances; and

b) With respect to administrative cases arising from acts done by the


detailed personnel in the receiving office, the receiving office in
coordination with the ITMS shall initiate the filing of complaint against
the concerned personnel in conjunction with the NAPOLCOM MC
2016-002, CSC Omnibus Rules and other related issuances.

6. ln the event where lT Personnel detailed is chosen or recommended by the


receiving unit to attend a seminar or training local and abroad, lT Personnel
should seek approval from D, ITMS for its concurrence.

c. Operations Superuision:

1. Performance of detailed lT Personnel in the accomplishment of lT-related


projects and func{ions in the receiving unit:

a) Detailed lT Personnel performance on their lT-related tasks in the


receiving office/unit shall be evaluated by ITMS through the Plans
Office based on their submitted accrmplishment reports.

b) Detailed lT Personnel that are proven ineffective in their current lT-


related functions and in the implementation of lT-related projects shall
have their detail order revoked or terminated earlier.

c) Detailed lT fficer should include in their accomplishment report the


lnformation Systems installed in the receiving unit, to show that lS is
maintained and operational.

2. Promotion of ITMS services:

Detailed lT Personnel shall promote the use of lT services whenever


possible to optimize resources, centralize coordination and
standardization of lT services such as the use of PNP ffice Websites,
Mobile applications, coordination for the development and integration of
lnformation Systems, conduct of Computer Literacy Programs, Computer
Security Awareness, Computer Preventive Maintenance services and
others.

d. Duties and Responsibilities of lT Personnel while on Detail:

1, Ensure that all lnformation System (lS) that will be developed in the
receiving unit can be integrated with the PNp Enterprise Resource
Planning System (ERPS).

2 Formulate plans and conduct activities for the successful implementation


of lT-related projects.

3 Ensure that lnform_ation Systems and lT resources are properly managed,


maintained, and utilized.

4. Assist in the conduct and maintain an inventory of lT resources (Annex


A), to be submitted quarterly to ITMS Attn: Computer Operations Division
(COD), available within the office/unit of assignment such as:

a) lnformation Systems;
b) Computer Hardware and Peripherals;
c) Computer Software;
d) Network components/infrastructure; and
e) lT skills inventory.
5. Observe the guidelines and procedures in the operation and maintenance
of the PNP Campus Network (as applicable);

6. Observe all existing policies, guidelines, procedures in the conduct on any


lT related projects from its conceptualization up to its implementation;

7. Assist in usefs training on lnformation Systems and/or lT-related projects


for implementation with the assistance of Training and Research Division,
ITMS;

8. Shall look into the security aspect of lS within jurisdiction;

9. lnitiate the development and update of official webpage and utilization of


official e-mail addresses of the office in coordination with ITMS WSCSD;

10. Shall evaluate all existing lS especially those programmed by ITMS if still
responsive or needs improvement/enhancement;

1 1. Submit Monthly PNP Personnel Accounting Report (MPPAR) (Annex B) to


Administrative ffice;

12.Shall encourage recruitment of lT personnel that shows potential; and

13.Submit Monthly Accomplishment Report (Annex C), Project Proposal


(Annex D) and Project Status Report (Annex E) to Plans Office, ITMS.

6. PROCEDURES:

a. Reeeiving Offices/Units shall initiate through a written request for the detail of
lT personnel indicating therein the purpose of the detail.

b. ITMS may detail lT personnel based on ITMS plans and programs.

c. The lrMS Personnel Placement Board shall convene and deliberate and
shall submit recommendations for approval of the D, ITMS.

d. Administrative office to prepare a memorandum to inform the receiving office


on the status of the request.

e. Administrative office shall prepare the Letter order for signature of the D,
ITMS.

f. upon approvar of the Lefter order, said order shafl be issued to concerned

S. Concerned lT personnel to be detailed will get said SOP from ITMS Plans
Office and will be briefed of their duties.

h. The receiving Office/Unit shall inform the D, ITMS thru the Administrative
Office that the lT Personnel have reported for duty.

i. Upon termination of detail, concerned lT personnel shall report back to ITMS


Administrative Office within seven (7) calendar days.

7. MISCELLANEOUSPROVISION:

a. Request for pre-tennination of detail either of receiving unit or the detailed lT


personnel of his/her details shall be subject for evaluation and recommendation of ITMS
Personnel Board for approval of the D, ITMS,

b. Upon the effect of this SOP, all lT Personnel whose detail has expired, unless
renewed, shall report back to ITMS Administrative Office.

c. Periodic review on the guidelines shall be done by the ITMS Personnel


Board subject to the approval of the Director, ITMS.

d. Detailed lT personnel shall sign the Letter of Undertaking and submit to


Administrative ffice.

8. PENALWCLAUSE:

lT personnel who will be found in violation any of the provision of this SOP shall
be a ground for administrative disciplinary action based on the existing PNP rules and
regulations.

9 RESCISSION CLAUSE:

All policies not in conformity with this SOP are hereby rescinded.

10. EFFECTIVIW:

This SOP shall take effect upon approval.

2. SCOPEICOVERAGE:

This MC sets out the guidelines an(l procedlrres in llle entitlement and availment of
the diFferent leaves granted to fersonnel of the Philifrpine National Police under existing
iaws, rules and regulations.

3. OBJECTIVES

a. To establish a system for lhe applicalion for leave of absence of all PNP
personnel; and

b. To establish implementing nrles an(l reolllalions on leave administralion


appiicable for all PNP personnel

4. DEFINITION OF TERMS:

a. Accumulated Servico Credits - refer to lhe lotal or running balance of unused


service credits excluding service leave c,redits

b. Actual Services - refer to the periocl of conlintlous aclive service since the
appointment of PNP personnel inchrding tll8 period or periods covered by any
previously approved lgave wilh pay.

c. AWOL - refers to the bLsence without official leave.

d Children - refer lo those living willr and deflenrlent lrpon lhe parent for support.
They may be unmarried, unemployed, not ntore tharl 18 years of age, or even
over 18 years but arP incapalre of self-stlpport beqause of mental and/or
physical defect/disabilily

Code of 1987 (Executive Order t'lo. 292)

l. Maternity Leave - relefs to lhe leave of ahsen(:e oranled lo female government


emplovBes legally entitled thereto in acl(lilion to vacation and sick leave. The
primary intent or purflse of granting malernily leave is to extend working
mothers some measuids of financial help an(l to f,rovide her a period of rest and
recuperation in conneciion with her pregnancy

m Natural Calamity - refers to a commonly declared natural calamity/disaster


which may include, but nol limited lo, earllrqual(es, flooding, volcanic eruption,
and landslide that have profor rnd environrnelt eFfecl and/or human loss and
frequently cause financial loss.

t-l Official Time - refers when a personnel is allowed to attend reviow classes
during office hours or working (lays on a hrll lime basis free from all duties
and responsibilities, yel enltlled to all l)enefits (i.e. salary, allowances,
incentives), and whosb leave shall not he de(lucted from his/her leave credits.

o Parental Leave - refers to the leave beneflls llranted to a solo parent lo enable

5. GENERAL GUIDELINES:

a. Vacation and Sick Leave

1) PNP personnel, wljether permanent or temporary, who render work during


lhe prescribed office hours sl'rall, after orre year of continuous, faithful, and
satisfactory service, be entillerl lo 15 days vacalion and 15 days sick leave
with full pay, exclusive of Salor(lays, SLrndays, and public holidays;

2) Unrformed PNP pdisonnel are only allowed ito clays vacation leavo inclusive
of five days mandatory leave ir'r a year excl ding Saturdays, Sundays, and
holidays regardless of the nurnber of accumlrlated leave credits;

3) Vacalion and sic( leaves shall be curnulative and any part lhereof, which
may not be taken iwithin lhe calendar year in which earned, may be carried
over lo lhe succeeding year,

4) Any PNP personridl who relires, resigns, separated or dismissed from the
service shall be enlitled to lhe commrrlation of all the accumulated
vacation/sick leaves to his/her oredit provide(l that his/her leave benefits are
not covered by special law;

5) PNP personnel wllo were dismissed fro[l lhe service for an administrative
case but latar exonerated and thereafler reinstated are entitled to the leave
credits during the period they were ot[ of ll]e service, if provided for in the
decision of higher authorilies,

6) PNP personnel who already exhausted hislrer sick leave credits can use
his/her vacalion leave credils btlt not vice velsa;

7) PNP personnel with pendxrg administrative case/s are not baned from
enjoying leave privileges excepl for leave al)road and study leave;

8) Fiting of an application for leave (excel)t sick leave) without,approval does

All travel sbroad for purposes of training, shldy oranl' observation lour, seminar'

i;dividuals sha'il be treated as a personal leave/underlaking of the personnel
concerned and should not involve any government or PNP funds, whalsoever'
However, any travel relative to the invitalion strall slill be on government expens€s
by way of his/her leave with pay. As such, the personnel concerned shall be
cover"d by existing regulations on addilional contractual service with the
government.

f. Study Leavs

Study leave for the purpose of taking pr(,fessional examinations such as 8ar

Exams, Board Exams, PRC licensure examinalions and the like should be
availed only once and not on a (lontinuing basis unlil the personnel concernad
passes the examinalion.

g. Transter of Leave Credits


When a PNP oersbhnel transfer from one oovernment agency to anoth€r,
he/she can oither have his/her accumLllate(l vacation and/or sick leave credits
commuted or transferrecl to his,/her new agency.

The second option can be exerclsed as a lnaller of right only by an employets


who does not have gaps in his/her service. llowe'/er, a gap of not more than one
month may be allowed provided same is not dr le t() his/lrer fault'

The option to transfer accumrllaled leave credils can be exercised within one
year only from lhe personnel's transler to ll"le new agency

This provision is not applicable to lralrsfer of leave credits of uniformed


personnelto the civilian service.

Terms and Conditioris:

4) Personnel shall seek approval of the apPlication for the said special privilege

Qualifications Requirements

The candidates q all be selected based on the following qualifications

the money value of the requared servir)e ol)ligation based on the salary
received at the time of his/her relirement, transfer or resignalion computed
on the numb€r of inonths he/slre was on study grant, including saliries,
allowances, and other monelary incentives received while on scholarshlp,
pursuant to all existing policies, rules, an(l re0rllations;

12)A proportionate refund of lhe monetary valLre of the PNP personnel's service
obligation shall be dllowed provided lhal he/sl]e has served at least 75% of

13)ln case the PNP personnel fails to complde llre rcview course/MA due to

subject shall be considered absent withoul official leave (AWOL), and such

h. MATERNIW LEAVE - Maternity leave shalt be granted to female employees


whether married or unmarried in addilion to vacation and sick leave. The primary
intent or purpose of granting matentity leave ts to extend working mothers some
measures of financial help and lo provide lter a period of rest and recuperation
in connection with her pregnancy

Terms and Condition!:

1 ) Every married mdle personnel is entille.i lo palernity leave of seven


days for the llrst four deliveries of his legitimate spouse with whom he is
cohabiting;

2) The first of the foljr deliveries shall be leckoned from the effectivity of the
Paternity Leave Acl bn July '11;, '1996;

3) Married male personnel wiih more than one legal spouse shall be entitled to
avail of patemily leave for an abso[rle nlaxan']um of four deliveries regardless
of whom ever gives birth; and

4) Palemity leave of s'dven working days shall be non-cumulative and strictly


non-convertible to cbsh. The same may be enjoyed in a continuous or in an
intermittent manner by the employee on the days immediately before, during
and after lhe childbirth or miscaniage of his legitimate spouse. Said leave
shall be availed of not later lhan 60 days after the date of the child's delivery.

j. SOLO PARENT LEAVE - The parental leave of seven days in addition to


existing leave privileges shall l)e Oranle(l to any solo parent employee. Solo
parent refers to lhe following:

1) Awoman who gives birlh as a resLrll of rape and other crimes against
chastity, even without a final conviclion of llre offender: Provided, that the
mother keeps and faises the child,

2) Parent left solo or alone with the responsibility of parenthood due to any of
the following circumstances:

2.2 detention or Jdrving of sentence of lhe spouse for a criminal


conviction for at least one (1) year;

2.3 physical/mental incapacily of spouse as cerlified by a public medical


practitioner;

2.5 declaration of riullity or annulment of marriage as decreed by a court or

Terms and conditions:

The parental leave of seven (7) days in addition to existing leave


privileges shall be granted to any solo parenl employee subject to the following:

1 ) The solo parent must have rendered government service for at least one (1)
year, whether conlinuoLrs or hrol(en, recli()ned at lhe time of the effectivity of
R.A. No. 8972 on Slptember 22, 2002 anrl regardless of employment status.

2) The parental leave ihall be availed of every year and shall be converlible to
cash unless speclflcally agreed upon previously. lf not availed of within
the calendar year, sbid privilege shall be forfeited within the same year.

3) The parental leave shall be availed of on a staggered or continuous basis,


subject to the approval of the head of agency/offrce. ln this regard, the solo
parent shall submit lhe application for parenlal leave at least one (1) week

4) The solo parent Alnployee may avail r)f parental leave underanyofthe

school programs, PTA meelings and the like,

4.3attend to medical, social, spiritual and recreational needs of the childi

4.4 other similar circumstances necessary in the performance of parental


duties and re;ponsibilihes, where pllysical presence of a perent is
required.

Conditions for Termination of Parenlal l-eave Privileges

1) Changes in lhe slatus and family situation of a solo parent such as marriage
or the concemed parent is no longer left alone with the responsibility of
parenthood shall lead to termination of parental leave privileges. However,

Application Procedures

1) The application fpr rehabiliialion privileoe leave shall be made through

2) Wnllen concurrence of a government pfrysician should be ottained relative


to the recommenddtion for rehabilitation if the attending physician is a private
practitioner, panicqlarly on the duration ot the period of rshabilitation.

Terms and Conditions:

1) For availing onesdlf of the Rehabililalion Privilege, performance of duty


means srtuations ,aiherein the official or employee was already at work. The
same privilege mdy be extended to officials and employees in situations
where the official or employee meets an accrdenl while engaged in activities
inherent to the performance of his/her (iulies, including being on offlcial
business outside of his/her work station, offi{rial lravel, authorized overlime,
on detail order, andbn special assignmenl orrJers injuries from accidenls
that occurred while the official or employee was going to work and
goang home from work are not considered sustained while in the performance
of official duties;

2) Absences from work during the period of Rehabilitation Privilege shall not be
deducted from the accumulated sick or vacation leave credits of the official or
employee. However, officials and employees while on Rehabilitation Privilege
do not eam and accumulate vacation leave and sicl( leave creditsi and

reimbursement by their agency f(rr firsl-aid expenses, preferably in

SPECIAL EMERGENCY CALAMITY LEAVE - PNP personnel, whether


permanent or temporary who are directly affected by nalural calamilies or
disaster may apply for said leave for five straioht working days or slaggered
basis. lt shall be a 1{ime applicarion and shor rkl he applied within 30 days from
lhe first day of declaralion by proner govenn',rert agencies/authorilies.

Application Procedures:

1) The application fqr special emergency .€lanrity leave shall be made


through lhe Civil Service Form No 6 (CS Form No.6) signed by the
employee and approved by the proper signing authorities with endorsement
from unit;

Copy of the Declarphon of Stale of Calamity by the Local Government Unil


(LGU); (Resolution from lhe Sanggrniang panlalawigan (Panlungsod/
Bayan) or national government (Exe,lr[iv6/Administr€tive Order from the
Office of the President);

lnformation Sheet or PDS); and

3) Certification from thq Barangay Chairman indicatinU lhe following:

official declaration of state of calamity

Terms and Conditions:

1) The purpose of the leave may be any of the following: for urgenl repair and
clean-up of damaged house, being stranded in affected areas, disease/illness
of employees brought by natrrral calamityi (lisasler, caring of immediate family
members affected by natural (ialamrly/disasler, anrl

2) A commonly declared calamity/disasler may include, but not limited lo,


earthquakes, flooding, volcanic eruption and landslide that have profound
environmental effecl and/or hr rman loss and frequenlly cause financial loss.

m. SPECIAL LEAVE UNDER THE MAGNA CARTA OF WOMEN . A SPECiAI IEAVA


granted to a female PNP personnel regarclless of aga and civil status, for a

surgery for gynecological disorders

Procedures for availment of lhe Special Leave Benefits for Female PNP
Personnel

1) The application for this special leave llenefit shall tro made through the Civil
Service Form No.6 (CS Form No. 6) srgned l)y the employee and approved
by the proper sagning authorllres,

2) The CS Form No. 6 shall be accompanied by a medical certificate from the


attending surgeorl accompanied by a clinical
summary reflecting the
gynecological disorder which shall fre addressed or was addressed by the
said surgery; the histopathological report; lhe operativo technique used for
the surgery; the duration of the srlroery inclLrding the pefl-operative
period (period of confinemenl around surgery); as well as the employee's
estimated period of iecuperation for the same,

3) This special leave benefilmay be applied for it'r a.lvance, that is at leasl llve
days prior to the scheduled date of the gynecological surgery that will
be undergone bylthe female PNP personnel. The rest of the requirements
specified in.item 3.2 of CSC MC No. 25, s.2010 under RA No. 9710
(An Act Providing for the fv|agna Carla ol Women) shall be attached to
the medical certificate upon lhe emplovee's return lo work under item 3 5 of
the same CSC MC;

4) The advance noticb for laking suclr leave would give the proper
authorities ampleltime and means lo prevent tha disruption of the
operations of the work .hrrang lhe absence of the employee and to
address the exigency of services of the oFiice;

5) In instances when a qualified female PNP personnel undergoes an


emergency surgic{i procedrre, the said leave application shall be filed
rmmediately upori t he employee's relrrrn from such l6ave following the

6) Upon retum to Work, lhe personnel concerned shall also present a


medical certificale signed by her altendin0 srr0eon.

Terms and Conditions

1) The special leave may be availed for every instance of gynecological


disorder requiring sqrgery for a maximrlm neriod of lwo months per year;

2) Generally, availment of the said special leave benefit shall be in accordance


with lhe List of Surgical Operalions for Gynecological Disorders, which
reflects, among others, the estimaled periocls of recuperation from surgery
due lo the specific gynecological disorder (Annex E). Minor surgical
procedures are thobb requiring a maximum period of two weeks recuperation
while major surgicSl procedlrres are those requiring a minimum period of
recuperation of three weeks to a maximum period of lwo months;

3) Other Surgical Operations for Gynecological Disorders which are not found in
Annex A of CSC lv]Q No. 2S, s. 2010 ur.rler RA No. 97'10 (An Act Providing
for the Magna Carta of Women) may te allowed sLrbject to certification of a
competent medical authority and submission of
other necessary
requirements;

4) The eerned leave iredits may be used for preparalory procedures and/or
confinement prior lo the surgery lVloreover, sllould lhe period of recuperation
after the surgery exceed two months, lhe female PNP personnel may use
her earned sick leave credits For the same lf the sick leave credits have been
exhausled, the vacqtion leave credits may be used pursuant to Section 56 of
the Omnibus Rules on Leave,

5) This special leave beneflt is non-cumulative and not convertible to cash,

6) Responsibilities of the Head of Office/Unit:

7) Leave credits of female PNP personnel whose periods of surgery and


recuperation due to gynecological disorders after the effeclivity of the Magna
Carta of Women and before the promuloalion of the Guidelines were
deducted against their sicl( or vacation leave oredits can have the said leave
credits restored an!/or appropriate gross compensation paid, as the case
may be; and

B) The spacial leave benefit under the maona carla of women took efiect on
September 15,2009 (CSC MC).

(Anti-Violence Against Women and their Clrildren Act of 2004)

Violence Against women 6nd their Children '- As (sed in lhe Act, the phrase
"violence against women and their children" shall reFer lo any act or a series of acts
committed by any person against a \/voman who is his wife, former wife, or against a
woman with whom the person has had a sexual or datino relationship, or with whom
he has a common child, or against her child whelher 169itimate or illegitimate, within
or without the family abod6, which result in or is likely lo result in physical, sexual,
psychological harm or sullering, or economrc al)use including throats or such acls,
battery, assault, coercion, harassment or arbilrary deprivalion of liberty. it includes,
but is not limited to, lhe acts enumeraled in Se.lion :l of lhe Act

Who are Entitled to a Ten-Day Leave * l hc following shall be entitled to a paid


leave of absence not exceedino ten (10) days, excepl as provided under Section 43
of RA No. 9262:

a) Any woman employee in the oovernment service regardless of employment


status, who is a victim of violer]ce as defrned under Seclion 3 of lhe Act.

b) Any woman employee whose child is a viclim of violence as defined therein


and whose age is below eighteen (18) or above eiohteen (18) but unable to
take care of himself/herself .

When to file; Submission of Supporting Document. - The application for


leave shall be filed, whenever praclicable, hefore tlre actdal leave of absenco or
immediately upon the woman employee's rehrrn from such leave. lt shall be
accompanied by any of the following supporlino documents:

a) Barangay Protection Order (BPO) obtained from lhe barangay,

b) Temporary/Permanent Proteclion Order([PO/PPO) obtained from the court,

c) lf lhe protection order is nol yet issued by the barangay or th6 court, a
cerliflcation issued py the Punong Barangay/Kagawad or Proseculor or the
Clerk of Court that the application for the BPO, TPO or PPO has been
filed with the said office shall be srfficient to support the application for
the tonday leave; or

d) ln the absence of lhe BPO/TPO/PPO or the certification, a police report


specifying the details of the occurren.re of violence on the victim and a
medical certiflcate maybe considered, at tlte discretion of the immediate
supervisor of the woman employee concerned

Manner of Availment - The woman who applies for len-day leave m8y
avail of the same in continuous or intermittent ntanner lo cover lh6 days that she has
to attend to medical and legal concerns

Leaves not availed of are considered waived.

7. RESPONSIBILITIES:

A. RMD, DPRM

'1) Ensure that atl necqssary informalion are wrilten in t!'re application for leave
and complete man(latory reql rrren)erlts are submitted;

2) ln case a leave cannot be favorably granted, the applicant should be


informed through ahy available means of communicalions;

3) Maintain a journal of PNP personnel spending leave abroad indicating


therein their destination and contact per6()n in lhe Philippines;

4) The DPRM (Attn: BMD) shall maintain records of all leaves granted to
personnelfor the pirrpose of commutation of lotal accumulated Ieave credits;

5) All applications for leave submitled lo the DPRM after the lapso within which
such leave application shoul'l be filed slrall be returned without action and
the endorsing persgnnel/administrative officer of the unit concerned may be
subjected lo appropriate adminislrative sanclion. and

6) Any application foi leave filed teyond tlre reglementary periods provided
herein shall be denied. The subject personnel shall be recommended for pre-
charge evaluation/investigalion as appli.-al)le.

b. ARMD, Admlnistrative/Personnel Officer

1) PNP personnel asbigned at NHQ/NSUS - Chief of Office/Unit shall indorse


approved leave application to DPRM (Attn: RMD) five days before the
intended leave,

2) Administrative/Personnel Officers of NllQ Offices/NSUs shall submit a


consolidated repo( of mandatory/special/service leave orders with approved
application for leave on a monthly basis to DPRi, (Altn: RMD) not tater
than the l0'h dayof lhe following montlr for incorporation intheSLRlS
Database;

3) Any application for leave filed beyoncl lhe reglementary periods provided
herein shall be denied. The subject personnel shall be recommended for prs-
charge evaluation/investigation as applioable, and

4) ln case of reassignment or detail of personnol, the losing unit shall transmit


within one monlh fiom the effecltvity of lhe reassiOnment leave records of the
concerned personhel lo the gaintng rlrrit ReqLtesls for transfer must be
accompanied by the leave records prior to approval of tho placement of
personnel.

c. C, RPHRDD, PROS

Adminislrative Disciplinary Authoities ancl the lnternal Affairs SeNice of lhe Philippine
National Police" fot uniformed personnel and the Revised Rules on Administralive Cases
in the Civil Service for NUP shall apply.

9. REPEALING CLAUSE:

All PNP rules, regulations and olher issuances, or portions lhereof, inconsistent with
these guidelines are repealed or modified accordinOly.

10. SEPARABILITY CLAUST:

Any portion of this N/lC inconsistent wilh lhe organic laws or declared
unconstitutional shall not affect the validity of the other provisions

11. EFFECTIVITY:

This MC shall lake effect after 15 days from the filing of a copy hereof at the
'Universily of the Philippine Law C enler in consonance with
Sectaon 3 and 4 of Chapter 2,
