Letter of Explanation

To
The Visa Officer,
High Commission of Canada

Sub: Application in response to study permit refused on 22/12/2021

Dear Sir/Madam,

I, Ishita Sharma, express my sincere gratitude to you for allowing me another opportunity
to present my application. I am a high school graduate aiming to pursue my career in the
field of law. Seeking my genuine interest in this study domain, Humber Institute of
Technology and Advanced Learning has also allowed me admission for studying Diploma
in Law Clerk at their prestigious institution, however, my application for the study permit
to Canada got refused on the following grounds:

- I am not satisfied that you will leave Canada at the end of your stay, as
stipulated in subsection 216(1) of the IRPR, based on the purpose of your visit.

- Pursuant to paragraph 220(a) of the IRPA, I am not satisfied that you have
sufficient and available financial resources, without working in Canada, to pay
the tuition fees for the course or program of studies that you intend to pursue.

- Pursuant to paragraph 220(b) of the IRPA, I am not satisfied that you have
sufficient and available financial resources, without working in Canada, to
maintain yourself and any family members who are accompanying you during
your proposed period of study.

- Your proposed studies are not reasonable in light of one or more of: your
qualifications, previous studies, missing marksheets, academic record,
language abilities, or your future prospects and plans.

- My previous education qualification reasoning –

I’m a high school pass out (2020), had commerce without maths(instead of maths I had
marketing) stream, I had minimum passing marks for my accounts subject reason being
I was never able to understand the same at all, due to my disliking towards maths and
numbers.(Had been weak in maths from childhood). In my school (commerce without
maths) stream was(is) closest to my interested field, i.e. Law(basically corporate law).

- Gap year reasoning-

From 10th standard I knew I wanted to study abroad, but when pandemic hit my family
was against it. Eventually when the situation started to get controlled I once tried to
convince my parents and thankfully succeeded in doing the same. (Note: Due to
Covid19 my high school result was withheld and declared around the mid-august of
2020.) From January-May 2021 I was working on my college and visa applications.
Applied for my 1st student visa application on 4th June 2021, received my refusal letter
on 2nd September 2021.

 After that decided to re-appear for my IELTS once again to increase the
writing module score.(That took 2 attempts)

 On 8th Nov, 2021 re-applied for 2nd student visa application, received the
refusal letter on 22nd Dec, 2021.

Justification/Answer to the Immigration Officer concern regarding my application:

- Why diploma course, why not just go for BBA LLB degree here in India??

See, after having experience accounts as one of the main 5 subjects and getting
barely passing marks, I learned that it’s better to be sure than be sorry about it later.
BBA LLB course is of 5years in total + University Fee and all my hard work and
even after that me still not having stable career out of it will be worst scenario for
me. In short, before stepping in to the field I want to have a short experience of the
same by studying the basics of it and then working (mandatory work placement
required to graduate) under the experienced lawyers and judges. Plus, my course is
different from paralegal and normal bachelor degree law course.

 As per all colleges, there isn’t any particular legal background requirement to
study the course.(You can check the same, I hope u do)

 The course includes subjects like contract, tort, real estate, corporate and
family, as well as in litigation, legal research, wills and estates. This all will
provide with the solid knowledge on diverse area of law, competence in
arrange of legal and court procedures and strong written and oral
communication skills for my future education and career. In simple words,
not only would this course me in having short experience of legal field/world
but would also help me deciding my future interest (specialization in one
particular area of law) in different and much more clear view.

- Financial Resource/Proof

 1st Semester fee (CAD $8,277) paid, have CAD $10,000 GIC certificate,
parents will be sponsoring my studies + FD savings for me (CAD $
17,227.26).

 I do have my family property net worth estimation value certificate by


licensed CA to show as a financial proof.

- Family Ties
 My whole family and friends are here, be it grandparents, aunt, uncles and
cousins.

 Never been away from my family, this going to be my very first time. As
already stated studying abroad had always been my dream, reason being it
will provide me with the experience that’s hard to find in my home country +
there are short term course which can be help in planning my future in my
home country.

 Moreover, my inability to live away from my family and friends is one of the
reasons I decided to opt for diploma rather than bachelor degree.

 I really want to come back after completing my studies, back to my family


and friends. I want to come back to build my legal career in my home
country, as this is where I was born and being the citizen of India I have some
duties against it and my family that needs to be fulfilled in any case.
