    The Patna High Court overturned Bihar's government decision to increase quotas for Dalits, backward classes, and tribals from 50% to 65% in state jobs and educational institutions, a move made based on a caste and socio-economic survey. The court's decision, responding to petitions challenging the legislation introduced in November 2023, halts the implementation that would have raised reserved seats to 75% including quotas for economically weaker sections (EWS).

    The Patna High Court has ruled that the Bihar Reservation of Vacancies in Posts and Services (Amendment) Act, 2023 and The Bihar (In admission in Educational Institutions) Reservation (Amendment) Act, 2023, are ultra vires and violative of the equality clause under Articles 14, 15, and 16. The move comes after the Bihar legislature in 2023 had given nod to increase the reservation for Backward Classes, Extremely Backward Classes, Scheduled Castes, and Scheduled Tribes from 50% to 65%.

    The petitioners contend that the legislations passed by the Bihar assembly last month, raising quotas in government jobs and educational institutions to 65% in addition to 10% reservations for economically weaker sections, were "unconstitutional".

    Patna High Court allows Bihar’s caste survey

    The Patna High Court dismissed all petitions challenging Bihar government's caste survey, which was ordered by Nitish Kumar. Dinu Kumar, a counsel for one of the petitioners, stated that he will move the Supreme Court against the judgement. The result allows the state government to continue the survey.
