Bengaluru: The high court Monday ordered issuance of notice to the state govt in connection with a petition filed by the Karnataka State Minorities Educational Institutions Managements’ Federation, challenging a May 20 circular requiring all unaided educational institutions to display on their websites and notice boards their fees and the admission process they follow.
Justice S Sunil Dutt Yadav posted the matter to next week. Citing the TMA Pai Foundation judgment of the Supreme Court and other subsequent verdicts of the top court as well the Karnataka high court, the federation had argued that educational institutions run by its members are protected under Articles 29 and 30 of the Constitution and that the RTE Act isn’t applicable to minority educational institutions, both aided and unaided.
