Assam’s first case under the new Bharatiya Nyaya Sanhita (BNS) law, which took effect nationwide on Monday replacing the Indian Penal Code system, has been registered at Nagaon Sadar Police Station in Nagaon district.
Assam chief minister Himanta Biswa Sarma, while announcing this first case under the BNS at Nagaon Sadar Police Station at 12.32 pm, said, “We have stopped registering cases under the defunct IPC since midnight and from now all criminal cases will be registered under the new law.” This first case in the state under the new law is a complaint by a rickshaw-puller after his mobile and savings of Rs 7000 was stolen from his home on Sunday night.
Nagaon Police Station OC Gopal Talukdar said, “We have registered the complaint under Section 305 (a) and investigation is on to locate the stolen goods and the nab the culprit.”
Section 305 (a) deals with “theft in a dwelling house, or means of transportation or place of worship, etc” and provides punishment with “imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.” This crime with the same punishment was provided under Section 380 in the now defunct IPC.
