Meerut: A special MP/MLA court in Bulandshahr demanded an explanation from the UP Director General of Police (DGP) by June 29 on the police’s failure to present a wanted former MP in court. Despite 53 non-bailable warrants (NBWs), the former MP has evaded capture.
Apart from the NBWs, multiple letters to various authorities, including one to UP’s home secretary, four to the DGP, six to the Bulandshahr SSP, and four to the SHO of Bulandshahr Dehat (rural), cops have not presented former Ghosi MP Hari Narayan Rajbhar in court.
MP/MLA court special judge Vinay Kumar Singh issued a letter to the DGP after police repeatedly failed to produce former Rajbhar. The court highlighted multiple raids “claimed by police” but no progress in locating Rajbhar. The DGP has been asked to explain these failures by June 29. The court has also written to the Lok Sabha Speaker and the Delhi Police commissioner, requesting details of the facilities provided to Rajbhar.
Citing the Supreme Court’s ruling, the court questioned the DGP in a written order: “Why should disobeying this court’s orders not be considered disobeying the Supreme Court?”
The court’s order emphasised the SSP’s responsibility to present an accused before the MP/MLA court, as per SC guidelines. The court directed that a nodal officer be appointed by the district magistrate (DM) and SSP to ensure compliance with court orders. The court noted that the non-compliance shows contempt of the court order. Rajbhar faces charges under six IPC sections IPC for allegedly demanding Rs 30 lakh from Dharmendra Singh in exchange for a promised post as chairman of the MSME Export Promotion Council, Delhi, in 2021. Singh paid Rs 22 lakh but was defrauded with fake papers.
“The court found him guilty and had issued orders to attach his property for his absence in court despite several summons. He submitted a bail application, which was rejected,” said adv Anupriti Yadav of the MP/MLA court in Bulandshahr.
In a similar case in 2021, Rajbhar was accused of fraud by Vikas Kumar, a BJP functionary from Rohtak, Haryana. Kumar alleged that Rajbhar defrauded him of Rs 40 lakh, promising a chairmanship of the MSME Export Promotion Council, Haryana. Following directions from Haryana home minister Anil Vij, an FIR was registered against Rajbhar on Oct 2, 2020. However, Kumar later died by suicide allegedly due to financial stress.
