Can use plenary powers to grant divorce, rules Supreme Court
The Supreme Court of India has ruled that it can grant divorce to consenting parties in cases of "irretrievable breakdown" of marriage using its plenary powers under Article 142 of the Constitution, but that grant of divorce is a discretion that must be exercised cautiously, not a matter of right. The six-month waiting period under the Hindu Marriage Act can be dispensed with subject to certain conditions.
