Judge rescuses himself in Four Lakes Task Force legal motion case

A Midland County judge who was overseeing the Four Lakes Task Force and the Heron Cove lawsuit had to recuse himself on Thursday.

MIDLAND COUNTY, Mich. (WJRT) - A Midland County judge who was overseeing the Four Lakes Task Force and the Heron Cove lawsuit had to recuse himself on Thursday.

Judge Stephen Carras recused himself from the case on Thursday because he is a trustee of a foundation that donated money to the dam restoration project.

"In this particular case, I have to admit that any decision that I make, if I felt that the law required a decision that was adverse to the account in this case, I might be more hesitant to make that decision for fear of what people would think was the real reason for the decision," says Judge Carras.

Judge Michael Beale will hear the Four Lakes Task Force's request to expedite the appeal of the property tax assessments.

A new court date for the motion has not been set.

Heron Cove, a group of lakeside homeowners, has filed an appeal challenging the lake-level special tax assessments. The Four Lakes Task Force has filed to expedite the appeal process.
