    FIR likely against UP builders for giving possession without registry

    NEW DELHI: The Uttar Pradesh state government has decided to file FIRs against all builders who have given possession of flats to owners without requisite registration of the flats constructed under the projects.

    “..We are getting many complaints regarding this. Due to the non-registration of the builder on behalf of the common man, there is a problem... We have decided to take strict measures for the good of the general public...,” Nand Gopal Gupta, Minister for Stamp and Registration (Uttar Pradesh) said in Lucknow on Friday. Gupta made the statement after talking to the aggrieved homebuyers.

    According to the govt, not only have consumers suffered, but the government too has recorded considerable loss in revenues. In Gautam Buddha Nagar, for instance, over 16,000 flats have been allocated to buyers without proper registration, which has led to a revenue loss of nearly Rs 475 crore to the state government.

    “The builders were issued notices regarding this, but they failed to initiate the process of registration,” said Gupta. The state government has been receiving complaints from buyers regarding the builders’ resistance to the registration of flats too. The buyers have complained that while they are willing to get the flats registered, but the builders have been putting it off for a variety of reasons.
