Maharashtra assembly speaker may issue notices to Eknath Shinde and Uddhav Thackeray today

The Speaker of the Maharashtra State Assembly, Rahul Narwekar, is expected to issue notices to summon the chiefs of the two factions of the Shiv Sena party, Eknath Shinde and Uddhav Thackeray, to determine which faction is the legitimate one. Both factions claim to be the original Shiv Sena and have the authority to appoint the party whip. The Speaker will hold hearings and consider the submissions of both party presidents in order to decide the disqualification case of the 54 Shiv Sena MLAs. The hearings are scheduled to continue until mid-January 2024.

MUMBAI: State assembly Speaker Rahul Narwekar is likely to issue notices on Wednesday to summon the chiefs of the two Sena factions — Eknath Shinde and Uddhav Thackeray — to decide which was the real Shiv Sena in June 2022 and had the authority to appoint the party whip. They are expected to be called for a hearing soon.
Legislature officials said that since both factions are claiming to be the original Shiv Sena, and with the authority to appoint the party whip vested with the leader of the political party, the Speaker will have to give both party presidents a hearing.
“Since the SC has asked the Speaker to decide the disqualification on the basis of which faction is the real Sena, both Thackeray and Shinde will be issued notices and they will be heard. They will be asked to make their submission on their claim of being the party president in June 2022, when the alleged split or rebellion in the Sena took place,” an official said. “The Speaker is carrying out proceedings under Schedule 10 of the Constitution where hearings are done as per the Code of Civil Procedure, and party leaders can be summoned for this.” While chief minister Shinde is an MLA, Thackeray is an MLC.
Last week, Narwekar had issued orders laying out the procedure and schedule for the hearing of the 54 Shiv Sena MLAs’ disqualification case. As per the schedule, weekly hearings will be conducted and are expected to continue till mid-January. Officials said the order on whether or not all petitions of the two Sena factions will be clubbed and a joint hearing will be given to the MLAs is likely to be given on October 13, which is the next date of hearing.

Raut also accused Narwekar of presiding over the murder of the Constitution. Sena MLC Ambadas Danve suggested that Narwekar may be facing pressure from the Centre or the BJP. BJP MLA Nitesh Rane has threatened to file a breach of privilege motion against Raut and Sena MLC Anil Parab for pressuring Narwekar.
Narwekar drops off Speaker's Commonwealth tour to Ghana
Maharashtra Speaker Rahul Narwekar has cancelled his trip to Ghana to attend the Commonwealth Parliamentary Conference. The cancellation was made before any criticism from the Shiv Sena. The Sena accused Narwekar of delaying the disqualification hearings of Sena MLAs. MP Sanjay Raut claimed that Narwekar's name was added to the delegation to Ghana to further delay the hearings. MLA Aaditya Thackeray criticized Narwekar for going to a parliamentary democracy conference while allegedly killing democracy in Maharashtra. Narwekar's schedule shows that the hearings are expected to continue until mid-January 2024.
