A: Who is eligible for the Adult Drug Court?

  1. Candidate charged with a felony offense that is either directly/indirectly related to a substance dependent lifestyle, and

  2. Candidate whose Counsel contacts the County Attorney’s Office within ten (10) weeks post arrest for the initial screen and approval; undergo a pre plea screening process at the Drug Court Office and be determined High Risk/High Need; and have a supporting substance use evaluation of at least a moderate or severe substance use disorder designation; ultimately approved by the Drug Court Judge, and

  3. Candidate must enter a guilty plea in front of a District Court Judge to the charged offense(s); admit to having a substance dependent problem, and agree to complete all requested Drug Court expectations.

  4. If a candidate has admitting charge(s) in B1 that are ten years old or beyond the candidate maybe eligible at the discretion of the Deputy County Attorney and/or Drug Court Team. 

 

B. Who is NOT eligible for the Adult Drug Court unless approved by the Drug Court designated Deputy County Attorney?

  1. Not eligible if candidate’s admitting charge is violent, such as: Murder, Manslaughter, Robbery, Felony Assault(s), Sexual Assault, Terroristic Threats, and or any gun related charges.
  2. Not eligible if candidate has their record previous multiple felony convictions.
  3. Not eligible if candidate is a documented and or is determined to have known gang involvement.
  4. Not eligible if candidates admitting charge(s) involve distributing large amounts of narcotics and or in possession of large amounts of money, indicting selling narcotics for reasons aside from supporting personal habit.
  5. Not eligible if candidate possesses multiple misdemeanor convictions for crimes against a person; Resisting Arrest, Assaulting a Law Enforcement Officer, Flight to Avoid Arrest or Weapons.
  6. Not eligible if candidate has any unresolved restitution.
  7.  Not eligible if candidate has active warrants.
  8.  Not eligible if candidate has multiple pending felony charges.
  9.  Not eligible if the candidate has graduated from any previous problem solving court.
  10.  Not eligible if the candidate has been terminated or voluntarily withdrew from any previous problem solving court.
